US Pilots Labor Discussion

A few observations if I may.

I think I finally get the East or USAPA strategy. It's very similar to the "Scorched Earth" strategy used by the Russians when Germany invaded. USAPA has sued everything but the potted plants in the US Airways Lobby, not so much in hope of victory but in hopes of frustrating the other side into capitulation.

If you look at the West as Germany and East as Russia, it kind of plays out (To Date) in a similar way. Army of Leonidas overruns USAPA in court. Result? More court actions, Kasher looks like a loser for USAPA and where are the pilots? no place close to a list or a contract. It occurred to me that USAPA can lose every single court case and still deny the implementation if the Nic Award for years to come.

So here everyone is. Dug in like the troops in a Russian winter waiting for an opportunity to make a decisive move. This is all about the senior folks on the e East getting to retirement age with all of the perks of their considerable seniority. Another 5 years of delay, which is entirely possible and then? Then it won't matter and a list will be generated and approved and maybe a few dollars in raises. Kind of a sleazy move but an effective one to date.
Obviously you dont watch the History Channel.

Time to crawl back to rehab Franke Disciple. The stress of 5yrs of waiting for the unattainable western nirvana is just a mirage. You are no closer than you were ages ago. You of all, have much to cry about. Crying2us about CLT. The mirage of unfulfilled dreams. Must be very frustrating to steal the eastern routes, then have to take the early van to leave on short order.
Duuuuuuuuuuuuuuuuuuh.

Nope, still can't do it.

I am laughing so hard,,,,,I am crying!!!!

The east hardline scabs are going off the deep end.

SH, you are way off. The West and Leonidas sued in Addington. Their Desert Judge over reached, and got them taken to San Fran and the 9th where Addingtons' wheels came off. How is that a loss for USAPA? Then it went to Supreme Court, or tried, a win for USAPA. Then Judge Wake got his drawers lowered, and he was spanked and his trial was ERASED. How is that a loss for USAPA? Then the 9th came out, and said the Nic was not the required list. All paid for by Leonidas. How is that a loss for USAPA? You honestly need to read something other than what the West says here. The only real loss for USAPA, was having the injunction on it. Every other major carrier has one. So really, how is that a loss other than the status quo for AMR, DAL, UAL having the same? If any organization has been the loser, it is Leonidas. They blew 2 mill in Addington, and have yet to get the Nic. Now Judge Silver is extremely aware of what happened to Wake , and what the 9th said. How is that a loss for USAPA?
This below is what Leonidas got the 9th to say, when they pushed Addington to the max. They got this little gem below. How is this a loss for USAPA?

[8] Plaintiffs seek to escape this conclusion by framing
their harm as the lost opportunity to have a CBA implement-
ing the Nicolau Award put to a ratification vote. Because
merely putting a CBA effectuating the Nicolau Award to a
ratification vote will not itself alleviate the West Pilots fur-
loughs, Plaintiffs have not identified a sufficiently concrete
injury.2 Additionally, USAPA’s final proposal may yet be one
that does not work the disadvantages Plaintiffs fear, even if
that proposal is not the Nicolau Award.3

And....what is astounding is that there are some westies who interpret that to mean it must be the NIC or SOMETHING BETTER to escape DFR II.
Wish I could smoke some of what they are smoking!!!!

I think we have a Boeing Boy cluless clone here, they must have at a ffocus session or something. He has not done his homework on Bill Franke of Dan Cloud I bet.

Im pretty familiar with the actions of one William Franke and why he isn't well liked by most Labor groups. However he's been gone ten years from HP and I doubt whether his legacy is near to where you think it is.

Sparrow, you don't have a clue about anything, when it comes to suing the west wins on that field you are obviously cluless on whats going on. The west will be nothing to us shortly, we on the east are so tired of subsidizing their losing operation. PS Doug does not have your back!!!!

The almighty West. Down to one base.......no widebodies......no international....flying 24% of east flying

USAPA said: "Returning to Open Session, and with the PHX Reps back in attendance, the Board voted 8-0-3 (PHX abstention) to approve that the law firm O'Dwyer and Bernstien, and Pat Szymanski,to represent USAPA in the pending Declaratory Judgment."

USA320Pilot asks: It is my understanding that Pat Szymanski worked with the Trump Shuttle pilots in their integration with US Airways and was one of lawyers in the firm of Baptist and Wilder. At the end of his dealings with the Shuttle pilots he went to work as the Chief Counsel for Jimmy Hoffa. I find this development very interesting. Could Mike Cleary could be selling out USAPA's DOH stall warts for a merger and national position with the IBT?

Maybe Courtney Borman and the Furlough Committee are having second thoughts on pushing so hard for Mike Cleary to be elected USAPA's President.

More on Pat Szymanski: October 27, 2011

USA320Pilot comments: When is the pilot group going to wake up and realize we are being played like a pawn by USAPA and their dishonest leadership? What's the real reason for the change in General Counsel and has the DOH stalwarts being sold down the river by Mike Cleary. Me thinks so...At least Randy Mowery got a new girl friend over this...

Patrick Szymanski
General Counsel, Change to Win

Patrick J. Szymanski is General Counsel for Change to Win, an alliance of seven Unions representing 6 million members in the United States, Canada and Puerto Rico. His mother was a Detroit public school teacher and editor of The Polish World, a bilingual newspaper published in Hamtramck, Michigan. Pat attended the Massachusetts Institute of Technology, dropped out in the late 60’s and later received his undergraduate degree from Wayne State University where he majored in mathematics. From 1978 through 1983 he was attorney with the San Francisco office of Beeson, Tayer & Bodine where he advised and represented Teamsters Local Unions and Joint Councils in Northern California, other labor organizations and related benefit funds in negotiations, internal affairs, arbitration cases and proceedings before various state and federal agencies and courts. From 1988 through 2002 he was an attorney and partner at the Washington, D.C., law firm of Baptiste & Wilder where he continued the practice of labor law representing primarily Teamster affiliates, related benefit funds and individual officers and members.

Pat became counsel to the Campaign of James P. Hoffa for presidency of the International Brotherhood of Teamsters in late 1995 and represented the Campaign throughout the 1996 Election, at the 1996 Teamsters International Convention, and in litigation that led to the 1998 Teamsters Rerun Election. He was named Teamsters General Counsel by General President Hoffa in March 1999 and served in that position until late 2005 when he became General Counsel to Change to Win.

He is a member of the bar in Michigan, California and the District of Columbia, the bar of the United States Supreme Court, and the bars of several federal district and appellate courts.

No, you moron, it's time for the adults to take over. Waiting is capitulation. Or stay on your ass in front of your computer and do nothing except polish you badge backer and let these retards in Charlotte spend your money.

But if you choose to do nothing then quit complaining.

Well, if the adults come up with a Nic-similar, Nic-comparative, Nic-corrected, or any other seniority list other than the Nic, I will be polishing more than my badge backer.

Are you still paying CLT dues, that is your first mistake?

Anybody going to the AOL Party on the 11th? Bands, food, beer...should be fun. Actually nothing is more fun than several hundred westies getting together, enjoying life, and laughing all night long at the East Idiots.

I'm sure our Reps will be there enjoying themselves as well as the "data thieves" on permanent paid vacation thanks to the Board of Idiot reps.

Government employee or contractor good for you! The private sector non-government reliance companies could use some business acumen from senior management of your sector

Actually, as a HR Director, its part of my outreach effort to hire veterans and guardsmen. I've had a good relationship hiring vets in my prior jobs, and I will continue to seek out and hire qualified veterans.
