Not the least bit suprised by that at all. Most of you are still living in 1978 with old school worn out practices that fail. No DOH, Kasher has adopted the companies take on the LOA 93 issue but old Tracy is lying to you stalling the verdict in that case. Usloppy fired their legal team in favor of another all too happy to take money from pilots too damn stupid to see that you are fighting for a cause that will never produce anything other than more legal bills. In a few years you'll fire them too as they also took your money and produced nothing.

It is official. The quest for DOH is DEAD. The "great one" the leader all the east wanted has admitted defeat. Mike Cleary the president that all of the hard core usapa supporters have blindly lined up behind.

Well it is obvious by Cleary's statement that the new lawyers have some concern for usapa's chances and are advising a change of course. You can bet the eastholes will still be trying to screw the west but the new attorneys are advising them to "soften" their stance and try to come in just under the dfr line. What shouldn't escape the east posters here is the fact usapa declared the seniority issue "settled" after the 9th, yet the unions president is admitting it is far from settled, i'm curious what what the east thinks about that.

usapa has seen where it has failed and where it has had success and is going to push where they have achieved those successes. They are going to attempt to do what the 9th said, and negotiate for a DOH list with C&Rs that slithers under the DFR bar. However, they will fail, here is why.

The "real world" expectation is determined by the usapa. They grossly underestimate the expectation of the AWA pilots, and grossly overestimate the expectation of the east pilots. The only way to calibrate any expectations is to compare the final usapa proposal against the Nic, and if it falls short for the West, it is a failure of their DFR toward the West.

I do agree that AOL is holding usapa under water. The problem is the 9th put a snorkel in their mouth and said, you better listen to what AOL is telling you, otherwise, AOL is going to put its ripe thumb over your snorkel.

Usloppy is not softening because they want too they are doing it because they HAVE too! DFR2 I dont believe there will ever be a need for this and here is why. The companies legal team have played this to the bone and that DJ filing was a brilliant legal move. Now the questions asked in that filing were such that it leaves no doubt but here is the MAJOR QUESTION that everyone on both sides should have followed and understood. Court, can you please hold harmless USAirways in a future legal filing by west pilots given the fact that WE SIGNED AN AGREEMENT HEREIN REFERRED TO AS THE TRANSITION AGREEMENT, FURTHER WE HAVE AS PER THAT AGREEMENT ACCEPTED THE FINDINGS OF THE SENIORITY ARBITRATION. I am more than certain that the companies legal team have advised them that the court system is not there nor is it designed to offer indemnity in civil cases.

Now take this along with the pending announcement from Kasher that he has adopted the companies version of events in the LOA93 case (his draft has been out for a while now) and he said that he would have the final version out in 30 days, well its been 46 days today so any day now that will be out. Tracy should have been honest with the east pilots but that RC4 mentality still lurks within the east ranks.

AA is saying its close to deal with its pilots but the window of opportunity is closing fast and a bankruptcy filing is still in the picture. IF and WHEN this happens there will be another mega merger and what better way to clean things up nicely than to merge with a company in bankruptcy that has just signed a deal with its pilots then offer our pilots their contract which MIND YOU will be better than both east and west current contracts. I am suprised that the great profit on this forum has yet to predict this vision.

3) 4.5 years later you are no closer to DOH than you were before you made Seham a millionaire

4) 4.5 years later after having spent a small fortune on the LOA93 arbitration despite being told you had no snap back provision you lose that case.

5) 4.5 years later you fire the very attorney the told you he could circumvent the arbitration award after he fails to produce.
