Even if 3000+ east and west pilots joined together to support a newly crafted compromise list it would still would have no chance of being the S22 list in a JCBA. The mechanisms that would allow for such a new compromise favoring the east pilots cannot prevent USAPA and US from being held liable for breech of contract, failed DFR, and collusion by one or a few pilots who wish to exercise their right to be placed according to the original list. The only two paths are for USAPA to accept the NIC willingly or for USAPA to accept the list under duress by court injunction. Legally, the time for compromise and negotiations has sunset. The NIC is the only list that can be used and the only one the company will accept unless Silver has an out-of-body experience and indemnifies Management from liability.

Bus, after years of lost time and wages and years of verbal abuse and insult both ways. Years of wasted monies on fruitless attempts. Years of giving Seham hundreds of thousands if not millions of our hard earned dollars for less than stellar legal representation. Its not enough that many of the pilots of LCC will retire under the worst contract in their history, or that this has given the management of LCC years of what will certainly amount to almost free labor. The actions of the east in this situation since the award was issued have been in my opinion repugnant however those pilots in the east thought they were doing was right.

I submit to you all that its not about being right people. Its about DOING RIGHT.

I just found out that Cleary's blast is already antiquated.

It turns out that USAPAs lawyers are moving toward a direct attack on the Nic using an expert witness to convey the alleged inequities to Silver.

Mediation was not the proper tool to use in this venue and Silver would never have agreed to it so they've moved to plan b.

And I don't think Silver wants to hear an expert cry on the east's behalf.

This is so damn pathetic.

And even if the company miraculously wins on Claim III and they get their blanket immunity (fat chance, but let's just go with it for now), there's still the DFR. The Jet America pilots had an injunction on the ALK-ALPA seniority list in less than two weeks, and then nine months later a whole new list was inserted that comported with federal law.

All roads lead to the Nicolau.
 
Would it be binding or could either party get a re-do if the don't like it?
What's crazy is that the East did have a good position to leverage their dissatisfaction by continuously voting down a contract using their separate ratification. Getting rid of separate ratification and the West as a separate bargaining entity were the DUMBEST things they could have done. Now it only takes about 20% of the East to join with the West to pass a contract with the Nicolau. If it's not the Nicolau, they have the problem of getting the company to negotiate and "buy" a lawsuit just so the East can have something other than the Nicolau.
 
Would it help to go back into arbitration and redo the list?
USAPA could always go back and ask George Nicolau if he would like to reconsider his decision. He alone retains sole jurisdiction over the HP/US pilot seniority integration. He's getting up there in age so they better move quick before tha door closes too. Best of luck with that.
