Cleary is brilliant, I'm sure he has heard that we have won LOA 93...
so now that the push for a contract can be slowed to a crawl, he knows the west will now be going nuts and wanting an agreement on the NIC and to push for a contract...
so the offer to mediate...

Please slow it down for us and put it in English. The west loves cleary..at least for the time being. (best money maker we ever had..🙂 I know pi brat, black swan, clubby/oldie, ect, ect and the rest of the usapa faithful get what your saying but what drink did you consume on a layover to make you come to this conclusion?

Unfortunately, that "winning" strategy is wiped out with two simple questions by Silver or the company lawyers, given that they know that there was both negotiation and mediation before the arbitration.

Silver: "Captain Cleary, is USAPA prepared to offer anything other than DOH with C&R's if there's mediation?"

Cleary: "No, your Honor."

Silver: "West class, is the west prepared to offer anything other than the Nic if there's mediation?"

West class: "No, your Honor."

Silver: In light of those answers, this court finds that there's nothing to be gained from further mediation.

Remember that whole binding part of the binding arbitration that was binding that you agreed to? Its binding, get it?
What K also forgets is that we already did this once before.

Why didn't the east negotiate in good faith before? Have they seen the light and now want to neg in good faith?

West class: "Yes, your Honor." We realize all the growth is out east and they make quite a bit more money that we do and just a few more years we will be able to bid the widebodys, and also we do not want to get sold off.

Remember that whole joint contract being the last piece of the puzzle thing? That thing agreed to by west and east in the TA? Seems a lot of folks lose sight of that in the Nic/DOH fight.

Doesn't matter, you agreed to a binding arbitration, then pussied out of it by forming a new union to avoid responsibility.

In your dreams. Funny that I see no westie here saying that. And forget about the class representatives saying that - they're your "Nic or die" equivalent on the west side. On the other hand, some of the east "DOH or die" disciples are talking about finding solutions...even Cleary... :lol:

It appears that you have east and west mixed up... :lol:

Why doesn't it matter? What good does binding do, if you can ratify? Look it up.
