Known since Nov 10. Now we know why Kim Jong Cleary suddenly wanted the West class to enter mediation.


Yup, I thought the same thing. What a true and honest totally east ran union we've here known as usapa!

I'm beginning to think that the only way we will get off LOA93 is through a door labeled NIC.
And the only way to access that door, is through a union called ALPA.
And the only way back to ALPA is a card drive.
And the only way to start a card drive is for CM to start working on one.

Someone please slap me.

You can start getting over it and take your cue from Piedmont.

I've always tried to work that way, forgive and forget. Sometimes I can, sometimes I can't, but as I posted before our group has let hate and anger blind us for years. How one side handles "victory" goes a long way towards that.

This event doesn't change anything, right now. Will it be the tipping point you guys hope for? I have no idea. At least I hope that's the only reason you would cheer a pilot group not getting more money.

If it's the Kirby+Nic, I'll take LOA 93.

I've posted before that your emotions doom you to perpetual failure. You guys don't challenge your leadership. You let them blindly lead you over cliff after cliff.

Look how many still think MDA will be a game changer. Pathetic really.

You guys beat on Chip, but at least he's not a lemming.

And I'd rather have more than Kirby, but this bankrupt union isn't going to get anything more than that.

Anyhow, now is the moment we've all been waiting for. What carrot does Cleary and his merry band of idiots have left? Can we PLEASE move on now? Please? I'd like to believe that the silent masses will become vocal... Or is it true that the senior folk really don't care about huge raises for the last couple of years... Wouldn't surprise me actually but one can hope the level of idiocy has been suppressed by this news. Oh... I forgot you senior folk wouldn't want to place any undue burden on your junior peers. I get it. I just hope they plan to offer some financial assistance to you when you're retired. You sacrificed for them right...?

Same here.

Will be interesting to see what goes down at the east in new few weeks. Lots of senior guys over 60 have said they were still here only because they were waiting to see if Loa 93 was a win. Didn't want to retire in off chance it was a win.

So question now is, will they go now that it is out? And if so, how many? If they stay there is a good chance the first T/A out for a vote would pass if it had a decent raise for them. If they have had enough and leave, then it's that much harder to get a NIC passed with a bunch of upgrades going that would be shut down by a NIC.

Interesting times ahead as always. 😀

Grievance Committee Chair Tracy Parrella provided the following information during today's BPR Special Meeting.

* Although the Union does not discuss arbitrators' decisions when in a draft form, we have very unusual and extenuating circumstances, which we believe dictate a change in our long standing practice of maintaining strict confidentiality -- for this specific dispute only.
It appears that the Arbitrator found that we did not carry our burden of proof.
* In order to prevail in this grievance ALPA's negotiators were required to do the following:
* The ALPA negotiators must have intended to have the pay restored on January 1, 2010; and
* The ALPA negotiators were required to clearly convey and communicate this to the Company negotiators during the course of negotiations.

We were able to present only one negotiator.
* The former ALPA negotiator testified that he had communicated these points to the Company; however, he was unable to produce any notes to substantiate his testimony.
* The Company produced three negotiators who were able to support their testimony with contemporaneous notes taken during ALPA's presentation of the pay reduction proposal, which contradicted the testimony of the Union witness.

We are still in the early stages of planning our strategy for the Executive Session, but it is unlikely that we will be able to get the Arbitrator to reverse his decision.
We will ask the Arbitrator to clarify several issues in the draft decision.
We do not see any grounds to appeal his decision to federal court.
Given the very recent receipt of the decision and the delicate procedural stage, we do not want to discuss this any further at this point, but we will give more detail after the Executive Session has taken place and the final decision has been issued, at which time the entire record will be immediately made available to all pilots.
Despite justifiable disappointment with the apparent rejection of the Union's grievance in LOA-93, we caution that no pilot may engage in any slowdown or other interference with normal operations. The injunction issued by the United States District Court remains in effect and continues to prohibit each pilot from engaging in any slowdown, strike, work stoppage, sick-out, work to rule campaign, or any other concerted refusal to perform normal pilot operations in violation of the RLA. The injunction does not diminish or interfere with the duty of a pilot in command to insure the safety of his or her passengers and equipment, but safety concerns may not be used as an excuse to engage in any slowdown or other concerted refusal to perform normal pilot operations.

So where does that put the west? We are really one group with a plywood divider between us. How do you succeed if we fail? That's what I don't get.

The union presented a comprehensive proposal to the company and they met yesterday to discuss it. Not too many details were presented, but it was framed as having significant movement from USAPA. We will see what the company does, but we can't do it ourselves if the company doesn't want a contract.

Maybe this will be a game changer, and the silent majority will rise up. I doubt it. I think they will see what happens with the DJ. Maybe a loss there combined with LOA 93 will do it, but I just don't see the Kirby passing, with many east and west voting against it.
