It's always something with you guys. Waiting for DOH, LOA93, PBGC investigation, east/west divesting, more retirements coming and finallymergers (did i miss any?). Sad state of affairs you guys have created for yourselves.

If it said in accordance with ALPA merger policy and that was part of the policy, why wouldn't US Airways be held to it or suffer the same legal threat.
Personally, I don't think there's much DFR mileage in the "according to ALPA policy" in the TA. They just happened to be the CBA for both sides. If USAPA represented the east back in 2005, the TA would probably said something to the effect of "according to the Allegheny-Mohawk policy" - ALPA and USAPA both have that in their constitutions when a different union is involved.

Again, to me, it's not lack of following ALPA policy that produced the DFR, since that policy was followed to it's conclusion before USAPA came along. It's trying to get out of an agreement that was completed as far as the seniority integration was concerned - a list was produced and accepted by the company (and even the two pilot groups since both agreed to accept the results of binding arbitration, but that's a different agreement).

Policies change - should a union not be able to change it's policies? USAPA changed the C&B/L to allow the BPR to accept new members after the original requirement that only base reps could do that - did USAPA do something illegal?

But let's review. You along with Aquaman said way before Nov 10th that we lost. You said the CIRP folks were called in. So, what was up with that?

I'm perfectly relaxed uhaul. Wasn't counting on it, just hoping sloppy language would finally bite the company and not us.
 
Hey Pi, can you explain this? 11/21 update said there was no decision yet in the second week of Nov it was released.

Grievance LOA 93 Update

This update is designed to inform the pilot group regarding the current status of Grievance LOA 93. We wish to start by unequivocally stating that at the time of writing we have not received either a decision or any form of indication as to how the Arbitrator will rule in this case. The countless rumors that have been spread in relation to this case are completely without merit and amount to pure fabrication. The high profile nature of this case has triggered many avenues for speculation and misinformation that have been falsely attributed to "sources in the know." We are aware that this misinformation has ranged from statements that the decision has already been received through to the nature of that decision. All of these rumors are false and we ask that you ignore all of these sources of misinformation. When there is definitive news then it will be released by the Union's Grievance Committee, and in the meantime, all other sources of information should be disregarded.

Grievance Committee Chair Tracy Parrella provided the following information during today's BPR Special Meeting.
Although the Union does not discuss arbitrators' decisions when in a draft form, we have very unusual and extenuating circumstances, which we believe dictate a change in our long standing practice of maintaining strict confidentiality -- for this specific dispute only.
Arbitrator Kasher suffered a very serious medical emergency approximately two weeks ago. He is recovering; however, he informed both USAPA and the Company that he would not continue his work until released from his doctor to do so.
During the second week of November a draft decision was released to the parties, and the Union requested an Executive Session, which was scheduled for December 13. Obviously, that has now been postponed indefinitely.
Unfortunately, the Union did not prevail.

This is not the victory that you think it is. Apparently the 3% annual raise isn't dead yet, so by next May, we will be at the same rates, domestically, and a higher rate Internationallly, as you West boys. Why the hell would we sign any contract with the NIC in it? Your pipe dream, eh? Kiss that goodbye.

It is unfortunate that you guys can't see what the advantage would have been for East and West if we had won the Kasher dicision......but I am not surprised.

It will be interesting to see if some of the "older" pilots begin to bail now. They said they would if we lost, we will see now.

If the East would have won, the company would have been incentivized to negotiate an new contract. Now, not so much. Both East and West are screwed by this decision.
 
Can the company be more forceful in who and how many use it to bailout early without true cause? Especially with a Federal injunction imposed against usapa by Judge Conrad.

If it's not in the contract, the company can't do it without it being grieved. The only leverage in the east contract is the split sick bank - after 60 hours/calenday year it takes more than just a phone call to scheduling to use sick time.

The injunction should have no effect on anyone wanting to retire early. I just question how many will.

You had better read that update better. The union did not prevail. They did not make the case to the arbitrator. The union did not carry the burden of proof. There is no 3%. It is dead and gone.

Now that this issue is closed we can move on. LOA93 or new contract and Nicolau. Those are your choices. There will be no money without it.

What are the captains holding a line and not going to bid the WB going to do now? Hold out so you junior guys can upgrade or demand usapa get a contract? With only a couple years left to make some money I think they will cut the angry f/o club loose and take care of themselves and their family.

Or is this where you refuse to accept rumors that the decision was out earlier, but now claim that rumors of possibly getting the 3% raises restored is gospel... :lol: Maybe I can call you "2Bite" for always wanting a 2nd bite of the apple...
