You guys keep asking for this information, but it's not something that's yours to have. Nor is it mine.
That's the point of going to court. To find out exactly the names of who did exactly what. This is information the veracity of which can only be vetted by the court. If it's real, the court will find out. If it's a USAPA pipe dream as you contend, the court will find out.
None of us, east or west, who are posting here are privy to the details of these allegations. This is a matter for the court and the principals involved in the case...not a bunch of USAviation pontificators.
So...please stop asking. USAPA's case will come out in court and at that time, when it becomes public record, you and I will know just what is going on here.

Well...almost everything. There will be a slight difference however....over 1,000 upgrades on the East, similar number of retirees, same pay rates except for the aforementioned upgrades. Like so many others, I'm OK with that. Separate ops and status quo until the next merger which is years away....Between now and then, this is just wasted bandwidth.

A couple of points, tazz. Over the years, seniority arbritrations have gone from nominal DOH with C&Rs to relative seniority with C&Rs and everything in between. Not sure where you come up with this "stapling." Its never been on the table. Only in SWA/Morris was staple a player and that was union/non-union, with no arbitration.
"How Nicolau saw it" is irrelevant. The NIC died on April 17th along with ALPO. Courts dont rule on fairness. They rule on the law. "Dura lex sed lex." Courts seldom grant injunctive relief on anything. Youll get your day in court, AFTER the USAPA list is in place. "Fairness?" Courts dont rule on what is clearly "in the eye of the beholder." They rule on the law. "Abusus non tollit usum."
Key word: "IF," but "Imposed" by whom? USAPA wont. The company wont. A Court? Go ahead and DFR. Not sure why your bringing up the theme of "stapling," when it was never on the table.
And for all the FUD from NLC and his ilk, even with the west deadbeats refusing to pay dues, agency fee, USAPA is far from being broke. Secretary/Treasurer Mark King then reviewed the Association’s finances. As of September 30, 2008, USAPA has unrestricted cash in excess of 1.1 million dollars and $250,000 in available credit. USAPA will be starting 2009 financially strong as what little debt is owed is scheduled to be paid in full by this December.
Want to run a DFR on USAPA? Go for it, but your dues money/agency fees will pay for USAPAs defense. Since we dont send 3/4 of our dues back to ALPO any more and we put our officers up in a dump, weve got the bucks to defend ourselves. snooper

Our wages are where they are because of an ALPO-induced concessionary LOA-93. That all goes away in 11 months. We snap back, contract or no contract. We also get two $35 Million bonuses in 2010 and 2011. As far as lawsuits are concerned, Id say youve got us matched about one for one. Also, if ALPO hadnt gutted our pension plan, I bet most of our over-60 pilots would have retired in the past 13 months. Instead, you can count on one hand those who have gone out of the 200+ who turned 60. We can go Sect 6 this June. Then well have some clout. Till then its just shadow-boxing. You have got to be kidding me! You claim that the New US Aiirways is somehow stealing from you or cheating you? You are working under a contract negotiated by your representatives (and now affirmed by an arbitrator to continue until you negotiate a new contract - just like your CEO told you a dozen times).Well, with that line of thinking, I suppose the company has an obligation to return the money it extorted? What would that amount to by now without interest? I'm thinking around 4B to the pilots alone.
Nothing should surprise you around here and nothing should be taken at face value, including the court system. Wether you recognize it or not; you work for organized crime and as long as you continue to look at USAPA as the source, you continue to be sidetracked, misled, and wasting time and money. USAir makes Enron look like amateurs and Arthur Anderson has nothing over this accounting dept.
