Judge Silver may be a nail in the DOH coffin, it's just that won't make the fight over.

I, for one, pray that Judge Silver makes a very clear (rarity for judges....see Ninth Circuit re Addington) ruling in favor of demanding the Nicolau list. I hope it is soon.

USAPA will then appeal that very clear ruling to the Ninth Circuit, and those judges will have to finally make a ruling on the central argument USAPA is making: Does a union really have the full authority under the RLA to negotiate matters like this in light of the policies of a predecessor union? No kicking the can down the road this time, oh esteemed judges of the Ninth Circuit!

Just sooner, rather than later, please, Judge Silver. We've been dancing around with lawyers, courts, company and each other over this crucial legal point for years now. Time to get it settled, because until THAT crucial point is decided, we are going nowhere.

USAPA stated that I. It's last telephonic meeting that it settled with the company regarding the injunction.

I thought settling was coming to a mutual agreement with a bit of give and take on both sides.

What is it the company gave? It sounds like USAPA gave up, gave in, and cried uncle on this, does it not.

I think you're asking the wrong question. In a general sense I don't think anybody has ever suggested that USAPA can't negotiate with full authority. The real question is far more specific than what you're suggesting. The real question is: Is the DOH scheme, after binding arbitration, arbitrary, discriminatory or in bad faith...IOW a DFR violation. We already know what a Jury had to say about it. Additionally, how does that DFR affect the company if they collude with the "Union"? You're completely ignoring the TA and the contractual laws that are concerning the DJ.

In your gut, do you honestly believe USAPA is on the right side of the Law? Do you REALLY think harming every single West pilot...to the sole benefit of every single East pilot is ever going to pass the scrutiny of a Judge? I think it's laughable on its own. Now throw in the fact that there is a 3 party TA and a final and binding arbitration award. Seriously?

The end is near. Whether certain groups ever choose to believe it is another matter.

A higher court is not going to matter. The company with a decision from Silver that they will be liable puts an end to this. The company is not going to negotiate with usapa for DOH or anything other than the Nicolau. SCOTUS could say no liability the company does not and will not change their mind. Read the transcript and court docs. The company admitted they think they need to use the Nicolau that is what they are going to do.

Just like line bidding vs. PBS. The company is not going to negotiate line bidding. End of story.
