Fellow Pilots,

After a clamoring for more updates from the Compass Correction Coalition at the PHL Domicile meeting yesterday, we respectfully share this little tidbit with our fellow Pilots at the personal risk of First Officer Dave Sye and his Mafioso releasing a torrent of personal dirt on us in order to quiet us.

We expect a resolution from McKee, Crimi, Ingram, Szpyrka, Gillies to audit CAPA, the Teamsters and the SWA Pilot Association to follow - aka witch hunt du jour!

Captain Cleary,

I am sending this letter to follow up on a phone conversation we had on November 18 regarding the communication piece you sent to your USAPA membership on November 6th. While your choice of legal counsel for USAPA is your business, I find it both inappropriate and unprofessional for you to publicly speak about other unions’ relationships with said counsel. In this case, such public correspondence is particularly problematic because your information is both misleading and inaccurate.

In your November 6th letter, you stated that SWAPA “terminated their relationship with Seham just this year for "incompetence and billing irregularities". It should be noted that SWAPA did not have a long-standing relationship with Seham, Seham, Meltz & Petersen, so there was no relationship to be “terminated”. We hired Mr. Seham’s firm for a single System Board of Adjustment/Arbitration in Spring of 2010 in which we were attempting to get a pilot reinstated after a termination.

The firm had been recommended to SWAPA by another Southwest union that uses the firm regularly. SWAPA chose to hire outside counsel for that arbitration because the subject-matter relating to the pilot’s termination was specialized, and Mr. Seham’s firm had done extensive work in that field. That single arbitration is the only experience SWAPA had with Mr. Seham’s firm. When that arbitration concluded, our relationship with the firm also ended. They were not “terminated” by SWAPA for either incompetence or billing irregularities. We elected to not use them going forward at that time.

Because your letter to the USAPA membership is misleading and inaccurate, I again request (this time in writing) that you retract the statements made to your membership and issue a correction about SWAPA’s past business dealings with Seham, Seham, Meltz & Petersen.

The Mike Cleary Issue

Innuendo, Versus Facts!

For those pilots who remember the USAPA President's message entitled "The Lee Seham Issue" of November 06, 2011, this letter from the President of the Teamsters Local 1224 will be interesting. Those who do not recall that particular message from Mike Cleary may remember it was largely a rationalization for unilaterally firing the Seham Law Firm.

Among his proffered reasons for this action was Mike’s assertion that most of Seham’s other clients were dissatisfied with the firm. We shall not dignify Cleary’s libelous claims by repeating them here, but they can be reviewed on the USAPA Website.

Cleary asserted that among those unhappy clients of Seham, Seham, Meltz and Peterson are the Teamsters Union.Well, the following letter, written to Mike Cleary from Mr. Boyd, President of the Teamsters Local 1224 is a full refutation of Cleary’s characterization of their professional relationship and a lot more. Enjoy the read. This letter has not been edited for content.

Dear Captain Cleary:

My name is Captain Robert Boyd former President and Chief Steward of Airline Professional Association (APA Teamster Local 1224). On background I have been employed at ABX AIR INC., former Airborne Express since 1979. During my time at Airborne I've had the opportunity to represent the Local's Pilots and Professional Flight Engineers both as a two-time elected Chief Steward for 4 years and two-time elected President of Teamsters Local 1224 for six years exclusively representing the Cockpit Crewmembers of Airborne Express.

I have recently reviewed a communication you distributed to your USAPA members making certain representations concerning Mr. Lee Seham of Seham Seham Meltz and Petersen regarding the legal services both he and this law firm provided to the Teamster membership.

As President of Teamster Local 1224, my appointed duties involved the direct hiring and oversight of the Local's staff legal counsel as well as the recruitment and hiring of outside counsel used in several specialized areas oflaw. The Local believed that the crewmembers it represented deserved a vigorous legal representation to protect their valuable careers and the Local cast the net wide to hire the best and notable in each area of law required to represent the membership.

I would request to go on record that to my direct knowledge during my tenure in office the only legal representation Mr. Seham provided for the Teamsters both at the Local or National level was for Teamster Local 1224.

Mr. Seham represented Teamster Local 1224 as outside lead counsel on cases that broached well beyond the areas of expertise and experience that could be provided by the Local's own staff attorneys. Mr. Seham represented our membership at RLA arbitrations, DOT ALJ legal hearings and before the NTSB. In every case his experience, commitment and tenacity helped the Local prevail in very difficult cases in defense of the members' valuable careers. While I am aware of Teamster criticism of Mr. Seham at the International level, that criticism was based on his representation of independent unions and not on the quality of legal services provided to Teamster members.

Given Mr. Seham's factual track record of service for Teamster members at Local 1224, I am requesting that you correct or retract your statements made to your membership concerning Mr. Sehams Legal representations of Teamster Pilot members. For the record we currently have members flying today, and providing for themselves and their families, as a direct result of Mr. Sehams involvement.

So now it is official, Useless air is going to bid on another bankrupt airline.
So how much money is in usappy's merger fund? With usapa that is almost broke, going up against an even more righteous group than the easties, this is going to be ugly.
If the east did not spend 10 million in a charlatan lawyer, chasing an impossible dream, that money could have been put in the merger fund so we all will be protected in the event of a merger. Now the west is along for a ride with a group that cannot punch their way out of a wet paper bag.
It will be a miracle if we all keep our jobs, give up on ever even trying for DOH with no merger fund and no lawyer on retainer to go to bat for us as a group.
With this election coming up, the east better do a gut check. Continue down this impossible path and get totally steamrolled by APA or band together and focus on the new front that will affect everyone at the "new useless airways".
At least look at the bright side, we can finally kill off the name usair.

No emotion in that post. Now, about that west voting for Cleary. You seem to have issues with some of the actions he led, yet you will vote for him again. Did you vote for him in the original election, or did you even have the right to vote. Be honest.

We'll see, but I'm not buying it. The west friends I have talked to don't either. Everyone of them feel that they will prevail on the Nic and there is not need to install a group of officer they don't believe in just to secure the Nic.

The majority of the west might vote for one candidate, but I think that will be Ferguson.
Why try? Even if our boys get elected, then what? Obama v Congress? Red v Blue? East v West?

No, Cleary does what we need him to do and that's keep you guys so polarized and emotional that you are ineffective.

And like you and the rest here have said, the Nic is on autopilot.

Cleary for president and Hummel for a foil. It makes for a great reality show.

Ok , Fair enough, just getting going in the fray, takes time to spool up.
No emotion, I am far away at this point, but I was and did vote Cleary last time. This is a new election, much has run its course, it remains to be seen who I will vote for next. At this juncture, it may not matter, it would be fun to put cleary back in so he can watch from the front row as this crashes around him.

As much as another merger would most likely suck as much as the last 3 or 4, I would almost welcome it, just to get rid of the "CatsAss" call sign!

The BPR's Spcecial Meeting Update on January 24, 2012 said: "Captain Mowrey then addressed recent crime issues having occurred at or nearby the USAPA Office. This includes a stolen laptop from VP Mowrey's office, and the assault and severe injury of a Sheraton Four Points hotel employee nearby USAPA headquarters. The hotel employee was beaten severely with baseball bats and this is believed by Charlotte Police Department to be a possible gang initiation. It was also stressed that all volunteers and visitors be vigilant and extremely careful when leaving the office."

USA320Pilot comments: Let me get this straight. There is now an increase in crime near the Sterling Hotel and at USAPA's Headquarters where a thief broke into USAPA's office, bypassed the video security system, broke into Mowery's office, and stole his computer that all went undetected? And, the thief was undetected by the office building's security system too?

It's election time and current EVP, Compass Coalition Candidate, and now USAPA president candidate Gary Hummel lead the effort to locate USAPA's headquarters at the current alleged crime infested location. Is USAPA's current leadership attempting to discredit Hummel since he objected to Cleary's attempt to force the headquarters move to a more expensive location?

Have the UEL political attacks and demagoguery started in a desperate attempt by USAPA's leadership to maintain control of the union?

In addition, Lee Seham is moving forward with his legal action against Mowrey for alleged email impropriety. Did Mowrey throw his laptop into the bottom of Lake Norman to destroy evidence that could be subpoenaed and used against him?

Did USAPA's expenses go up when Mowrey ordered a new computer for his personal use immediately before his VP tenure ends? If Mowrey takes his new computer home following the election as a line pilot will USAPA attempt to recover their property?

With the Permanent Injunction in place and the last NMB mediated negotiating session tomorrow has USAPA provided US Airways' pilots with one single benefit? And, with rumors floating that pilot discipline and terminations will increase what useful benefit is USAPA to US Airways' pilots?

With the continued prospect of destructive east-west pilot relationships after USAPA's officer election would US Airways' pilots be better off rejoining ALPA based on the national union's track record at other carriers or disbanding USAPA and being non represented pilots?

Are US Airways' pilots headed to 3 more years like the past 3 years if east candidates win USAPA's officer elections? If the ReformUSAPA candidates win the election will the pilots see the RC4 double to the RC8 and then Ferguson firing all USAPA Committee members and replacing them with West pilots? Will the pilot civil war continue with greater intensity at the expense of the line pilots?

When will the pilots decide to put the past behind them and to work together because it's the best way to succeed? Or is it about power, greed, and ego instead?

A colleague wrote an interesting description of this event. He said, "Sounds like either the Mission Impossible Team or KOAS was out to steal Mowery's computer or maybe it was just part of the gang initiation. They broke into USAPAWWHQ, avoided all of the electronic surveillance gadgets, found the Office of the Vice President. They then went directly to the locked drawer, picked the lock, removed the laptop, relocked the drawer, defeated the security system once again and made their way out- all undetected and without leaving a trace, just to get that one computer...Sounds plausible to me."
