That is not a question judge Silver is addressing, at least not directly. She is reviewing Counts 1 & 2 to determine if a non-NIC list is a DFR per the RLA or if a non-NIC list is not a DFR per the RLA. The Company presented ample proof that USAPA is bound by the TA (CBA) as the successor union and that Management has not accepted any modifications to the TA which would allow for another list to be used. Since the Ninth only evaluated ripeness, the Addington trial is the best evidence available on what would trigger a DFR for USAPA in this specific case. What the jurors found in Addington will carry a great deal of significance for Silver now that the Company and the west class have focused the issue down to very simple question - is USAPA bound by the TA to implement the NIC by federal statute or not? I think even Tashima and Graber would have a hard time side-stepping the clear and obvious choice before the court this time around.

Absurd or rational, doesn't really matter... the real issue is that the West spends so much time trying to persuade East pilots to agreeeeeeee with them.... Even the West knows it all boils down to votes, ...binding ratification. The 9th knew it, Wake was schooled. The company knows they have to negotiate with the union and the West will eventually is attempt to get a judgement and supposed damages, if there ever is a ratified list with these two groups. The fastest way for the West to buy their vacation homes, BMWs, and boats is to simply tell the company to quit playing around and do a DOH list with USAPA paying for a big fat insurance rider for the company. But for now the company doesn't want to lose its excuse for avoiding negotiations.

Finally, USAPA asserts that “US Airways’ delay in asserting this claim has
severely prejudiced USAPA because US Airways has delayed bargaining for an integrated
contract.” (Doc. No. 152 at 26:7-8.) Nothing could be farther from the truth. US
Airways was engaged in active collective bargaining negotiations with ALPA before the
Nicolau Award was issued, and it proposed a comprehensive CBA almost five years ago,
in May 2007. (Supp. Sep. Stmt. ¶ 6.) If USAPA and US Airways’ pilots have been
prejudiced by delay, that delay was not caused by US Airways.
 
The parties - plural - can make changes to the TA. USAPA can not do so unilaterally no matter how much the majority wants to change some things.

Yes plural as in US Airways and USAPA. "Unilaterally" means one, USAPA + US Airways = two. There is no longer a west component of ALPA so USAPA will have to represent the west interests.

ALPA had one shot at rejecting the seniority award - they could have said that it didn't meet the requirements of merger policy. Unfortunately for the east, ALPA's BOD decided that the award did satisfy the policy. ALPA had no ability to modify or negotiate the award per it's own C&B/L's once the BOD decided.

And a future court case with the NMB, USAPA, US AIRWAYS, and AOL will determine the seniority list. So you cannot say with absolute certainty of how this will all play out. In all probability with oil prices skyrocketing US Airways will cease to exist or either the APA at American will become involved and there is no way you could predict the possible final outcome.

The problem with your statement is that when you actually read the transcript, the statement reads more like this: "that USAPA is at least as free to abandon the Nicolau Award as was its predecessor, ALPA." How "free" was ALPA to abandon the Nic?

How "free" were we to abandon ALPA?

US Airways has had the Nic since December 20, 2007. Why isnt it in use today then? How much longer before you think you will see it? 5yrs, 10yrs, ever?
 
But then I was elected as president of the homeowners association and we changed the rules. I then bought another 1/4 acre lot next to the original one and then I built my house that covered 1/3 of an acre. Then everyone was happy so we had a neighborhood picnic.

Oh, and I put in a pool too.

Well there is your problem!! In your situation you PAID for or bought another 1/4 acre. With you east guys you want to take the 1/4 acre live on it use it up, make us pay for the pool and upkeep until you die then let us have back what was rightfully our to begin with.

Can usapa negotiate a seniority list that places all west pilots at the bottom of the seniority list?

If not why not?

Actually it is YOUR problem.

And you want the Nic so you can jump ahead of others that have paid their dues. You want the widebodies that you didnt bring to the merger. Overall the east is slightly expanding the west are shrinking- thats why you are flying 24% former east routes. The growth and attrition favor the east - you want that too.

You guys are like spoiled little children with entitlement issues.

There is a long line at the grocery store cashiers lane.......another lane and cashier open another up..........the entitled west brats bolt for the newly opened lane ahead of others in the original lane completely disregarding the positions of others ahead of them that have been standing there longer. Thats how I see you guys.

Where is your DOH? Contract? Why is LOA93 still here?
