As judge Bybee asked. Could you place all of the women junior to all of the men? DFR? Could you place all of the redhead senior to everyone else? DFR? Could you pay pilots different rates depending on base but not equipment? DFR? Could you place 85% of one group junior to furloughed pilots? DFR?

Bybee was drawing some boundaries there and giving a few digs..of course there is indeed a point where a union could overstep its bounds (and thus face a real DFR.) One of those “Title” rulings I believe that extend beyond the RLA. Being the superhero outhouse lawyer I am .... this line of questioning was not really relevant.......of course you cannot discriminate on strictly the basis of Race or Sex in any context, other than picking the next lineup for the Rocketts for next year’s Xmas show. A little give and take from the bench, but all in the room (except for the heart surgeon) knew the real answer.

Fact is, DOH with fences and restrictions holds up just fine in our legal system, and will preempt your unquestionably ripe attempt at DFR II.

No further progress required, other than attrition. Most of us old gaseous emissions are gone in a few years. This is the end game. Other than a very unlikely win on LOA 93...we are done.

You're my point. I could say the sky is blue and you would argue that point so you can get your seniority jump. You just returned from furlough, you are wet behind the ears. ALPA uses information paid by its dues members so Jerry Glass can use it against you. You spin it to your selfish needs. Stick to the point I made.

I do not expect the west pilots to understand this because they were hired by an airline that accepted applications and hired from a pool of those that could not get hired by anyone else. Darwins theory of pilots evolution.

First. I need to acknowledge a mistake. It was judge Graber the woman that asked the question about can you make women junior to men.

Yes it was relevant. She picked her favorite minority and asked Seham if it would be OK to discriminate against them.

You guys all rely on the DOH "gold standard" thing. Sure during neg/med/arb. it is OK. But after an arbitrator rules it is over. The majority does not get to throw out an arbitration after the fact. The majority does not get to decide what the C&R will be for the minority and still avoid DFR.

Would it be a DFR if all women were made junior to all men? Even if the C&BL said so.

Yes Clear. If we put all women junior to all men it would be a DFR won, the CBL be d.....d. Agreed.

That has nothing to do with majority or minority. DOH with Conditions and Restrictions makes the cut just fine, as you will soon learn. Even wtih the CBL "d.....d."

With 1700 east pilots on furlough. You have a higher percentage of returning from furlough than a west guy. We had zero at the the time.
