Here is what I can tell you. First let me wind back the clock. We reached a TA with Fleet last summer but the TA failed ratification. One of the provisions contained in the TA was the withdrawal of the Change of Control grievance. As you know had that grievance been won by the Union, then East pay would have snapped back to higher 2003 levels. We also heard that many employees felt that they had a strong case in the Change of Control grievance and wanted to see it through.Once the TA failed we all focused our efforts on getting the CIC grievance "asked and answered" and there were no negotiations during that time period. Last month, we received the arbitrator ruling and the arbitrator agreed with the Company that the merger did not constitute a Change of Control, as defined in the Fleet Service agreement. ( BY OPINION only. It was the cheapest/quickest way to a resolution rather than be tied up in the courts for who knows how long...)
At that point, both the Company and the Union agreed go get back to the table to see if we could now reach an agreement. We met for our first session in late January and have another session upcoming in PHL next week. In terms of the details of the discussions, at this point in time in order to ensure that we don't do anything away from the table that could adversely impact those negotiations, the Company has to suggest that you approach your Union representatives for specific details. We are, however, quite hopeful that we can reach a Transition agreement in the near future.
