Three way is a fair guess, but how she actually gets there is a challenge.

Wake's example is, in my mind, a warning to Silver, rather than an encouragement for her to follow any shared desire to help out the home team.

Her own example in the DJ is the only thing I have to go on.   Though she was all over the place and inconsistent, in the conclusion she reluctantly sided with the law.
While I really don't have a problem with the 3 way, I don't see it happening. Used to. As long as the same formula is applied to all pilots, be it DOH, relative position, ect., USAPA can fairly represent the west. There should be no stapling as that has proven to be the root of so many problems in the past.

see following post, so much for the west claim that all the retirements are FO's.

I'm in the 200+/- range on the system list (even with the Nic....LOL!)

My number went up 48 slots from Jan, 2013, to Jan, 2014.  That's 25% of the really (REALLY) senior pilots gone in one year.  And, as Karen Carpenter famously sang: "We've only just begun..."

Indeed sir, and I'd further note that "with fences" pretty much precludes the APA from having even ANY reasonable concerns for the longer term. Ourselves and most of our fellows will shortly be gone.

Whatever else can be said of this whole fiasco; at least we'll be able to leave knowing we never broke the faith and sold out any of our "junior" comrades for our own convenience. I'll sleep just fine with that knowledge, as I'm sure you will as well. 🙂

In the ALPA days, the senior pilots were always accused of throwing the junior guys under the bus.  The excuse was: "Just be patient.  You'll be senior someday."  But deregulation, radically changed hiring practices and 9/11 wiped out that promise of inevitable seniority.

At least we changed that paradigm of "throwing the junior pilots under the bus" with the advent of USAPA.  For that, I am proud of all of us on the east.

Your meager signing bonus, USAirways pilots, will be sent sometime in January 2014, when the company finds the time and after the america west pilots law suits.  The American Pilots will get theirs on "Day 1".  BOHICA.  Happy holidays everyone.
Thanks for all you do.  USAirways pilots your retro pay may be at the end of December, if the company has time.  Sometime during "year 1", the company may pay USAirways pilots................................

"On Day 1, the Company will deposit shares of the new American Airlines (AAL) equal to the pilot's share of the Day 1 equity distribution (minus approximately 30% for income and payroll tax withholding) into a brokerage account at ComputerShare. At that point, those shares will immediately be under the pilot's control and may be held, sold or transferred as desired."

Come on.  Enough of this.  You are comparing apples to oranges.  The APA, on the bankruptcy unsecured creditors" committee, secured the $100K because it was OWED to them as creditors.  It was not part of their compensation package as labor.

Like I said, just trying to predict what Silver will rule. Any legal corrections, admonitions or reversals from the 9th is the subject of the next installment of 'let's play legal expert'.

So I'll stick with 3 way. Like east said, Wake I at the AZ level didn't conform to RLA law either.

Well, if you are correct, I will stand by my promise to EastUS1 to place the "crow on the dinner plate" in my avatar pic.  And you can enjoy that, too.

I think I might really enjoy Silver ruling the  way you think.  It will keep the circus in town for at least another year or two, and I can then afford the premium seat to watch the performance.  The show might even outlast my 973 days (but who's counting?)

This was the ALPA move that got them launched off the property. There was no going back after this. You should have seen the idiots ALPA picked as their new leaders. The biggest zeros of the base.

ALPA would have been better served if they had closed their offices and went on retreat for the period of the balloting.  They would have returned to find ALPA still the CBA at USAirways.

The crap they did seemed surrealistically geared toward driving the USAirways east pilots OUT of ALPA.

You may be right about ALPA surviving the representational election, however, once the NMB election was underway ... the seething anger toward ALPA since even before the pension give-away, as well as the never-ending ALPA dirty tricks, overflowed and the east pilots became more united than at any other time in my memory.  For many, ALPA just poured an accelerant on those smoldering embers, and for once, the majority of east pilots were not buying their BS.  For me....placing Council 41 in Trusteeship, ensured ALPA’s demise.

While I agree that USAPA has not been the phenomenal success we had all hoped for, they accomplished much during their projected short tenure, including holding the NIC infested rabid dogs at bay.  Good work USAPA and thank you.

What's the other part of that "accomplished much"?

"Good work"?  GMAFB

Better yet, whoever makes bold predictions with supreme confidence, multiple times, which are then completely wrong should do two things.

Change their avatar to 'Caw'.

Add the following signature, 'The crows seemed to be calling his name, thought Caw'...Jack Handy

🙂

Annoying the hell out of you?  Although, I expect that's not a great accomplishment in a world where you are alright and its the world that's all wrong.

Don't spend all your USAPA "accomplishments" in one place.

Name one thing other than delaying resolution of the Nicolau Award that USAPA accomplished.

By the way, the world is not on USAPA's side and you're the one that sounds annoyed (everytime I post).

Obviously, in your world, the world is indeed on your side.  Some day I may be senior, but alas I will never progress to the point of grasping the opinion of the whole world. My sincerest congratulations of your accomplishment, sir.   🙂

I too am proud that we stuck together in getting rid of alpa. Although I retired very senior I was thrown under the bus twice and I never forgot it.

Cheers,

Bob

ONE other thing?  That's easy.  In fact, it's their very first accomplishment.  Tossing ALPA into the gutter.

See, it really makes no difference if the world is not on USAPA's side.  Because the law is.
