The wager isn't a thing of the past and remains open young one. Given my obvious decrepitude: one can only assume your reluctance to be based on tender concerns for my feelings and fragile ego, and/or of course...your universally displayed "respect" for your "elders"....? 😉

Think of all those new hire eastern div. Just piling on top of the furloughed Ferguson Listeners. And making it look even worse for the stagnant PHX operation in any merger. No wonder U Haul is so snappy.
 
So when 100% of the west and a large percentage of the east vote NO on the first DOH contract, what will USAPA do? Well, they only have the DOH card to play, even though the east probably would vote it down in hopes of getting more money the second time around. So will they try to placate the easties with further punitive measures against the west, since they can't get anymore money (DOH took it all). And how will that play in front of the judge that will impose the injunction blocking it (possibly Wake or Silver)?

Ironically, the move that would pave the way for a DOH list without much risk would be to put out a contract with NIC and let it be voted down. They would have cover for DOH the second time around. However, since they don't trust the line pilot with any vote, it's likely not to happen.
 
In the event of a merger, I think USAPA will be able to go into negotiations and if necessary arbitration representing the best interests of all USAirways pilots to achieve the best possible JCBA within the context of it's CB&L's. It's not going to be the NIC, not unless the CB&L's are changed, because as it stands now, those are the parameters they are bound by.

I have no doubt in my mind that there will be unhappy pilots regardless of how it turns out and if it is done "fairly" there will be just as many, if not more, happy pilots. When you think about it, ANY SLI places nearly all pilots at something of a relative seniority disadvantage, except for number one.

First the C&BLs are not the only parameters usapa is bound by. As a matter of fact, federal law, the RLA, MB and a host of other laws all trump a C&BL that in itlself was written to break the law.

Second, if uspa drops two lists...immediately the response from everybody else in the room is going to be to contest the two lists.

Third, if at arbitration, it is highly likely the arbitrator would reject the two list, particularly once made aware of the nature of usapa...their failed DFR..and the existance of the Nic.

But, I am sure the east and usapa will totally screw up another arbitration, not having the faintest clue and unable to even read the multitudes of warnings the courts have already issued.

Yeah..I am thinking of the one who has the same last name as a certain high level flight operations manager who now has a conflict of intrest in performing his job.

And Pi thinks there is no way to make a collusion claim.
 
Is the company bound by usapa's C&BL? Does Parker give a crap what they say?

If it come down to following usapa's C&BL or federal warning what do you think he is going to do?

Could usapa put in their C&BL that usapa gets to decide who is the CEO and who sits on the BOD of LCC? If it's in the C&BL it must happen right?

So whatever our CB&L's say that's what we have to do!? And Silver said we are free to negotiate?! Why don't we change the CB&L's to read that all America West pilots shall be stapled to the bottom and shall be first officers for the rest of their lives. I mean c'mon we can now do whatever we want. There are no limits! The CB&L's should tell the company what our pay rates have to be too. Lets start with $500/hr for the East and $5/hr for the west. If its in the CB&L's then that's what it has to be!!!!! We are free to negotiate/dictate! We are finally in control of everything!!!!

That sure is collusion. Collusion with Fergusons' posterior. They were offered work. And they listened to a guy with a job (and trying to leapfrog others) tell them to stay home. Meanwhile there are rumblings of merger, and the eastern division starts on a huge hiring binge. Not too smart.

Among the many things I've wondered about regarding the whole west business is how ANYONE (above the age of 13-16, tops) could choose to follow some oily little ferret of a new hire, without ANY airline background, who self-styles as the "Supreme Commander" of the...umm..."army" of leonidas. I can remember my incredulous laughter coming from just the creature's useage of terms like "supreme" or "ultimate" sacrifice pertaining to just the idea of possibly losing a friggin' job....You just couldn't make such infantile, grandiose and sadly delusional BS up...at least for use with any adult audience. Such people need to grow up!...Period!

For any of the west persuasion that find this post at all offensive: Would you be so kind as to explain Fergie's use of the childish and grandiose terms referenced above?....Preferably in some manner that will make sense to those who have only distant memories of adolescent perspectives and fantasies? 😉
