I guess you're partially right - I speculate based on known facts while you speculate apparently based on nothing more than a desire to defend of USAPA.

USAPA can never get beyond it's pride and just drop the suit. Because of the arcane laws that favor a union over the interests of the individuals involved (member or not) unions have deeper pockets to fund their juggernauts. It takes a membership that refuses to have it's money wasted (and since under RLA you can't protest the union's actions by witholding dues, so no one ever thinks of dues as anything but a tax in the abstract) to stand up and force the union to abandon wasteful vendettas that serve only to sooth the pride of the union bosses.

A USAPA TEA Party, so to speak.

You must have missed the Plaintiff's entire case in chief, where all kinds of exhibits were admitted into evidence which demonstrated that USAPA was formed as a mechanism to avoid the arbitration. When something is admitted into evidence in our court system, they become legal facts and arguably there isn't anyting in existence more factual than legal facts as nowhere else I can think of is there such an intense distillation and filtering process as with the Rules of Evidence.
 
B/S is unaware of the two lost arbitrations because they don't directly affect him/her. But when presented witht he opportunity to vote on changing the west contract to change the age 58 bypass to age 63 (something that equally did not affect him, but could have resulted in many west F/O upgrades while increasing the affected age 58 pilots salary) how did he/she vote?

USAPA gave the east pilots a free shot at the west and they took it and with it they took potentally thousands if not millions of dollars from the west pilot group.

Educate yourself before you vote.
 
Because the judge wouldn't let them hear the whole truth. That will be Wake's embarrassment at the hands of the 9th.

And if the 9th doesn't find your way, will you scapegoat the 9th? Of course you will, its never USAPA's fault that they couldn't live up to an agreement they signed.
 
No, because the judge would not let them rule on the fairness of the Nicolau award.
