1. If it was "perfectly good", then why did ERISA kick in? The validity of which is only now being called into question.
2. The ATSB said we could not have the loan with the pilot DB plan hanging over the company's head.
3. The bankruptcy judge, Judge Mitchell I believe, said we could NOT exit bankruptcy with the DB plan intact. But he also said he would not take it by force. We had to decide whether we wanted to continue as a going concern.
IMO, the vote was ceremonial at best. The great majority of East pilots wanted to keep their jobs. Fact is, the pension was lost months earlier when the MEC decided to sit on information provided them by members of the negotiating committee, that the plan was in jeopardy and a freeze was still an option for a limited time.
Had the vote not been taken that night, we wouldn't be here now. Had the MEC that followed during the seniority negotiations had that kind of courage, we could have negotiated a reasonable seniority integration (assuming the West pilots negotiated with the same level of commitment to a settlement).
