So the westies are having a big party on the 11th. I really think the 10th would be a good day to hear we won the LOA 93. I'd love to see 20 drunk pissed off westies crying in their beer. The "wife" over sitting in the corner wondering what its going to be like when she gets home. Golfboy at the door checking I.D.'s. Fodase and nick4us burning their union cards. The rookie trying to convince Golfboy that he is a pilot. and so on and so on. somebody take pictures and burn them because we dont care. If the east wins the LOA 93 please let be on the 10th.

And my best guess is that if she saw in that way, she would have granted USAPA's MTD and gained some more breathing room on her docket. Instead she embraced the Company's idea that harm would likely come if they told USAPA "nothing but the NIC" and also that harm would come if they told USAPA, "whatever non-NIC you want to use is fine with us".

It is the company's dj, not usapa's. Her decision should only answer the company's three questions.

The part I love about the West PBS, DPU, MAESTRO, and Trip Trade Board is the availability to be able to schedule your self and make instantaneous changes with a Smart Phone.

This is just another example of how USAPA's approach is hurting the pilots.

In the company's prayer for relief a non-Nicolau seniority list is the legal context of questions 1&2. Question 1 asks the court to declare a non-Nicolau list to be a violation of the union's DFR under the RLA which prevents USAPA from being released to self-help over section 22. Question 2 is the opposite of Question 1 which asks the court to declare that a non-Nicolau list is not a breach of the DFR. In both of those questions the Company is asking the legal implication of accepting a non-Nicolau list. Siegel effectively asks the same staring on page 13 of the MTD Hearing transcript.

If judge Silver thought the Comapny could answer those questions on its own without legal risk she would have dismissed the matter. Instead she declared that the DJ was ripe and exemplified the reason why the DJ provisions have been put into law. The Company left her with an open-ended option for relief, but not providing a legal answer to the question of NIC or non-NIC isn't one of them.

I'd disagree with the bolded part, although it may be what you meant. Question 2 asks the court if accepting a non-Nic list is a violation of it's contractual responsibilities - i.e. can the company accept a non-Nic list and not be legally liable. The company doesn't ask the court anything about USAPA's DFR status if a non-Nic list is agreed to in negotiations.

Silver could rule that the company can accept any list it finds acceptable and not be legally liable (not likely in my opinion) but that would still leave USAPA on the hook for a potential DFR suit.

What payrate, protections, and work rules would it take to have you vote "yes" on a NIC contract?

I am not trying to bait you into anything, since i have always said Tempe CAN pay enough to get a NIC voted in. I just don't think Doug is willing to cough up enough to do it.

My short list:
- Vacation
- Deadhead
- Retirement contributions
- Insurance
- Reserve rules

320 captain should be in the $160 range based on recent trends.
330 & 767 should be in the mid $180 range.

320 f/o should be around $115 putting them within striking range of current captain rates.
330 & 767 f/o should be around $130.

These are not top of the industry rates but should keep us competitive. I think there was a time we could have gotten more. But based on current events I think these are realistic targets. I am also willing to give here and there. One area would be PBS. The right system could actually work well from those I've talked to who use it. Of course the down side is productivity, which is why its such a priority to the company. But negotiations are often a give and take. Saying you will never use PBS is like saying you will never fly a 2 person airplane. It's time to join the rest of the world in the 21st Century.
