Ah, the victim defense. You are probably here more by your choices than I am by mine. I sought an alternate route when this started. From your posts I'm guessing you have backed the west strategy from the get go. Your choice, but accept that you guys had choices. You picked what you thought was best or maybe even the only route for you, but a lot of people were trying to work with east and west for an alternate solution. Accept your decisions and stop whining about the road they have taken you down.

No whinning at all so let us not go there. These "alternate routes" that you speak of came after the fact. Once it was decided to go to arbitration both sides knew what that could mean. The parties both participated in the process both parties chose the panel and both parties presented their case. This was over and done back on 07 and because of the size of the east group you chose to bully us out here. Now both sides are stuck because the east went back on their word.

There is zero honor on your actions Pi and even less when you say lets do a deal after the fact. Now if you are talking we in the west take 100% of all the economics of a new contract along with furlough protection and you stay on loa93 for the duration of your attrition issue then maybe we can talk. No? This is not appealing to you in the east? Not fair you say?? Well you are only concerned about fairness when it effects the east negatively but when it effects us it matters not to you. Selfish.

I'm not talking about fair, I'm talking about what was and is.

Pi like Aqua said, paid better than you. I enjoy weekends and holidays off. I enjoy better contract provisions. I have better INS and pay less for it regardless of what side of the country it is. Hey if you are happy in your situation that makes me happy.

have no idea who is here. I dont contact anyone personally and have no idea who anyone is on either side. I see screen names and leave it at that. Knowing who people are on such a hot topic forum can only produce trouble that no one needs.

Oh Im just guessing it's mostly AFOs based on tone and content. So are you a capt.?
 
So the company cannot afford a contract that doesn't include the Nic, but if we turn down a contract that includes the Nic the company can afford to to sweeten it enough to make it pass? That's some logic there.

You seem to have missed my point. Yes, IMO the company can not afford a contract that will please 100% of the west with DOH. The tipping point to get 51% of the east to accept the Nic would be a much lower threshold. They just need to keep trying until they get enough people to reach that threshold.

This is mostly a moot discussion because if I'm not mistaken we both agree that the courts will settle this. If the DJ does not give the company immunity from DFR II, then Nic will remain in section 22. If they are granted immunity (highly unlikely IMO) then I guess we are destined for DFR II. In that case we'll all be on the hook for our union's decisions.

It should be obvious that the company is playing the East and West against each other and will do anything they can to save a buck.

You guys should really give up on this NIC idea and join the party going on here in the East.

I believe that we on the west are quite willing to wait for the court to decide. You would have to be delusional to think that we would be willing to join your party after all we have been through.

If we even capitulate one iota we will have lost to you. Rather take our chances on a win against you.

Furloughees leapfrogging West Captain's? Never happen.

I am a west captain and should DOH ever see the light of day east pilots who were on furlough when the acquisition was announced will be hundreds of numbers senior to me. That's a fact and I would call it leapfrogging.
 
The Dec. ruling should be out by April. LOA93 Loss will have been handed down to USAPA and that reality will have had a few months to percolate among the silent majority. I, and others a hell of a lot smarter than I, believe that Judge Silver is going to effectively end this debate by telling the company that they are absolutely liable if they touch the Nic. The law is clear. It is illegal for the company to enjoy the benefits of a new contract that work as a DFR against a group of employees. All AOL has to do is persuade the Judge enough that a DOH contract is indeed a dfr and will make the contract Illegal. Guess where all the evidence for proving that fact will be imported from? Wait for it.......

The case that was dead, buried, meaningless, and forgotten will be back front and center to haunt USAPA. Being a Jury already found against USAPA for DFR in regards to a DOH list....how hard is it going to be to convince Silver that a DOH contract is a DFR?

It's a no brainer. USAPA is doomed and they damn well know it. Thank God they finally are getting competent legal advise.

This will be over by April.
