So, exactly who is usapa going to negotiate with???........Answere, nobody.

The 9th did not say anything about the company's liability in this case. The only people they warned was usapa...and although usapa is too stupid to heed the warning, that does not mean the company can't read the writing on the wall, and avoid collusion with usapa in their DFR quest.


Oh, one more thingy...Cleary's request for mediation does not make the West look like an unreasonable mob.....ummm!!!!!

We already have a list that was the product of negotiations, MEDIATION, and arbitration.

The "union" either uses the list or they go pound sand. So simple a usapian can do it.

Oh, and the company's has repeatedly claimed they have "accepted" the Nic, and have also said in court that they remain neutral, and do not bargain the seniority list. They just accept what the union gives them. The problem for usapa is the company has refused to take the DFR DOH list.

From the begining that was the flaw in Seeham's plan. It ain't a crew meal. The company does not negotiate each individual pilots seniority, the union does. We did, the east wants to renege, ain't gonna happen.

Mitchell ain't gonna like it because he ain't going to get paid, cause we ain't gonna use him.

Yes, they ruled on it, but you seem unable to grasp the meaning of those words. They ruled solely on the legal theories, not on the reality of this case. And even when ruling on that theory, they spoke as to the results of the current USAPA course of action.
