Breeze lacked conviction in his beliefs and thus had to remove himself from these boards. He cried long and hard enough to the mods to put me in a time out for four days, but that was a sacrifice I was will to make for this forum.

No change here boo boo. It seems that in the last few days you guys are starting to figure things out. You've got eastie beating on eastie here, easties who hate Cleary, easties who are sick of USAPA, easties who want a new contract even if it's with the Nic, and Seham suing easties.

Life is good and i don't have much to interject. Breeze is gone as are many of the other tiresome east posters do I have little else to do but keep Pi in check.

You have not read the latest filings since you say this. The west and the company want summary judgement by April. Both of those parties want this thing done quickly. Whould you like to take a guess at usapa's proposed schedule?

Yep, full discovery. Expert witnesses to tell the court how bad the Nicolau is POST merger. usapa does not want this to go to trial until November 2012. So who is delaying the answer?

As far as junior staying junior, I agree 100%. A furloughed pilots is junior. He will stay junior. A reserve F/O' was junior he will stay junior. A senior F/O will stay a senior fo and and a line holding captain will stay a line holding captain. See the Nicolau meets your requirements.

1- Ferguson is on his own power trip....he is impressed that someone thinks he represents the West pilots.

2- He betrays his agreement with Cleary to keep their meeting to themselves.

3- He accuses the East pilots of causing this problem and how USAPA now wants them to help fix it....BS!

4- He basically states that come hell or high water, there is no way the West pilots will try to work something out to end this mess.

Thanks for posting this Move....good info for the courts.

It is not the west pilots going to usapa looking for answers. We told you we will see you in court. That is where we stand. How many of you told us that buy now want mediation? Finally yuo are beginning to understand. How long have we been teling you this? No the west pilots will not mediate and arbitration. It is the Nicoolau end of story. Ferguson told Cleary that. The reps told the board that. The lawyers told the court that. Are you guy able to read and understand english?

You know what is good for the court. The legal update that said the C&BL say it has to be DOH. No court in the land is going to force mediation when the guy asking for it has a set in stone position. Besides, what happens if the mediator tells you it will not be DOH just like Nicolau did?


So NO mediation. No negotiations. Nicolau as written. Understand?

I think the west is being "asked" only to fill the squares when it comes time to go to court. You know, simple examples to the court of the continued west intransigence.

That is okay, keep acting in the expected manner, it only gives the east more ammo.

Aside: the west must have been pushovers for Mr. Parker, before. Nothing any child psychologist couldn't figure out.

Why would Silver care about this letter? He have hopes it'll be used against us? More pathetic and wishful thinking?

Eric is a rep and part of the AoL leadership that protects our legal rights to DFR. It was Cleary that sought him out for his little game of "see, we tried" and correctly, he told Cleary to pound sand.

And of course it's the east's fault. You guys are the ones begging for compromise and resisting every legal effort to get this resolved. So no, we're not going to help.

What your little mind fails to grasp is that by allowing any compromise to the Nic, we set up a Trojan horse to where USAPA can come in and gut even more of the Nic. That's why the door stays shut. Not only because we owe you nothing, but because legally we'd open a pandora's box.

USAPA is seeking a time frame of discovery that will take almost a year. The company and the west class don't want to waste the time. USAPA will not be allowed to reargue the Nic. I see their request for discovery being denied.

Oh, as an FYI, the meeting was reported to our attorneys. Only someone with your lack of insight into the process would think this board had any influence on anything.

And for christ's sake, if your sister is brain dead, or dead, stay off the damn boards for more than a week out of respect for her. And if not for her, do it for me.

Mediation could work but not with this west group... so the fight goes on and separate ops remain... The problem is you think i'm upset about this in some way? Not so much...

I will never accept the NIC as it stands, and the west has just said they don't want to talk about a way out of this mess, so here we are.

talking would not of hurt anyone, maybe reasonable people could come up with a solution....

I'm sure the laywers love it....

Maybe we could of bumped up some west into the 517, Maybe we could of put a fence in for x number of years, maybe we could of if there is a furlough make sure no west gets disproportionally harmed...

maybe if the west wants to go east we use DOH, if the EAST wants to go west we use the NIC.

hell there are plenty more ideas to solve this mess.

I'm open to discussion but the west says no, we are too smart for that..

the fight drags on and it will be no quick fix...

since you have slammed the door in our face, I will make sure my reps know that no matter the outcome of Silvers court or the 9th appeal we keep up the fight...

The new developments, are mighty interesting. The western are good at ignoring good intentioned advice. From Wye River to George Mitchell they ignore. They ignore Freund, they ignore Abner Mivtka. The western listen to the identity thief. Very telling. It will come to haunt them in the courtroom of Silver. The protege of Clinton. Those who are mediators, take poorly to disciples who ignore them. The judge will pay close attention to the western intransigence. The western do not recognize when the power has clearly shifted, and they are powerless. This was proven when their bought judge was punished and shamed. Give thanks western disciples, for the wheels of justice will now deal with those of you who are seeking things they do not deserve to have. Continue to listen to the disciple who has stolen the identities, and flaunts his beard. Telling.

I see all this as an attempt to find some way to get us a new contract. I know there are a great many west pilots that think if they can get a judge to say NIC must be used December that we will have a contract by April.

I think USAPA knows that at present considering every offer we have seen from the company and their public statements concerning how they "Cannot pay what American and Delta can" there is slim to no chance of gettting the east to vote yes on anything with NIC.

I am sure there are a few that might vote yes on something now, but their number appears to be so little as to not matter. I may be wrong and time will tell. But given what we see on the east I don't think so.

Parker CAN get a NIC voted in. But as I said before he is not willing to pony up the payrates that will do it. With what parker is willing to pay the majority of the east pilots feel they are better off keeping the attrition vs any token raise that they would see from Parker.

To get NIC to pass on the east (and I suspect by the west Captains) Parker will have to be paying something around 110 to 115 for F/O's on Busses which is close to Capt pay now, Bus Captains will have to be close to current widebody pay, and widebody will need to be on par with the other guys. Anything else will not cut it with all the attrition coming up once you consider the other factors suce as line vs reserve, wide body f/o vs narrow F/O, vacation, base bids for not commuting etc etc.

Just my opinion on what I see out there. Time will tell though.

I disagree, we could accept the NIC or the west can accept DOH and you will still not get a contract that would be worth anything.
