And you do know that once (if) there is ever a ratified contract. Only then can you file a DFR and try to prove that you were actually harmed 'from the point of ratification' and based upon the conditions and restrictions that are not even completed; try to show the difference in what you 'think' you deserved... Good luck! It shouldn't cost you more than another 2M....

You won't be able to there Swan. "pain of unquestionably ripe DFR"..means just that PAIN. As in you get this ratified, the West makes the case that it all started with the election, and usapa and possibly the company would be on the hook for damages back to 2008.

Ripeness, once settled by ratification, does not determine onset of discrimination, or start of damages.

Wonder why BS and others don't quote that part of the 9th's decision??? Could Silver's ruling be one of those "contingencies" that the 9th mentions???

Quite possible.

The 9th also said if they ruled to uphold Wake's decision, it could actually prolong remedy for the West.

Don't see Swan quoting that either.

I'm not saying that the 9th forecast the DJ motion and subsequent ruling, but they made it clear that they couldn't predict what might happen that would keep USAPA's proposal from being included in a ratified contract. Hence the "not ripe" ruling. Certainly the DJ motion was one of those things they couldn't predict.

It's equally interesting that the 9th said that USAPA's proposal is clearly a DFR violation - they mention both the jury verdict and the harm USAPA's proposal would do to the West. Yet BS, Hate, Mikey, Luvn, and others keep insisting USAPA's proposal is legal... :lol: Like the TA, they pick out the tidbits they like and discard the rest.

I warned you 3 times to leave my sister's death out of your posts, but your adolescent tiny brain just couldn't do it.

Now...the ONLY reason I am back on these boards is to bust you at every turn, so you better watch your foul mouth......I am going no where.

Like I said, the "time out" was very educational for me. My foul mouthed meltdown a couple of weeks ago was totally intentional, trying to test the system to see what it took to get the attention of the moderators. I actually got a very nice personal email from the head cheese of this board, explaining how this thing works.

Now.... you can learn the hard way or the easy way, your choice.

Use kid gloves on this tough guy. He tested the system by running to an admin to tell on me and have my account be one step away from suspension.

And now he's tough because the admins are fighting his fight.

You're better off ignoring him.

Move is now bringing up our accident record, and naming names. And attacking the moderator! Others think the scheduling hearing with Judge Silver will deliver the Holy Grail of the NIC to a vote, all of us working under NIC by April. Wow. And now BB is saying the Ninth said the West had a valid DFR, but only that is was not ripe. I knew that turkey drug made everyone prone to sleep in front of the big game, but had no idea it had Peyote in it!

The scheduling hearing will come and go. Judge Silver may or may not tip her hand with questions or statements..but she will eventually follow the law, even it takes another trip to Wake's woodshed at the Ninth to move thing along correctly. No disrespect meant to the fine Judge at all, but it happens to the best of them in the desert.

I find Cleary's hookup with Eric much more interesting forum fodder, and not because who outed who...obvious that was intended. Anyone know what they were wearing, or what they ordered at the restaurant? Pictures, anyone?

If I were a furloughee on the West right now, I would be fishing (and not cutting bait.) This is not going to be pretty. Anyone follow the events of TA 9 and its follow up grievance? 30 per month (minimum) on the East starting very soon, forever. Anyone going to pass on that recall? We shall see, but anyone on the street should be praying for a combined list, yesterday.

Tell you what, as I usually do (and probably not soon enough) I will go silent until the recounting of events in Judge Silver's court are presented by both sides. Fork in the road guys, but the West seems to have one tire flat and is (again) veering only one way.
