Kubic is gone.

He resigned to keep his job. Apparently the company persuaded him to move on from his union position or face termination.

Just like Valerie Hayes. No one has heard from her because the company told her to STFU or lose your job.

That came from an eastie and I appreciate your confidence in not questioning my credibility. But I have my east sources to thank for that.
 
Yes. Ucrapa can appeal all they want if the DJ doesn't go their way. The company is looking for an answer in the DJ and will run with it whether ucrapa likes it or not. This is the end game. Deal with it, easties.
There's an injunction in place (insurance policy) that limits how the east can "deal" with it.

Am I the only one who thinks that DFR2 will not be a re-hash of Addington but a new DFR against USAPA for failing to negotiate in good faith and instead "Parking Itself" (as opposed to being parked by the mediator, which may happen as well) in order to accrue more gains to the east at the expense of the west?

Nope, there are all sorts of ideas presented here that would, if successfully adopted by USAPA in negotiations, lead to an entirely new DFR.

I heard another rumor that PHL Domicile Rep Eric Jordan has joined Communications Committee Chairman Scott Theure and Safety Committee Chairman Tom Kubik in resigning their USAPA positions. Has anybody heard the same rumor? Union activists are leaving a sinking ship....

If there is a DRF II it will be initiated by east pilots suing ucrapa for failure to provide DOH, as spelled out in its constitution. Very shortly the judge will affirm the company's belief that it is obligated to the Nic and the Nic it will be.

No, I could see that. USAPA would have to be very careful. I could also see DFRs filed for any number of reasons as the Addington DFR has been every effective at stalling a contract. What is to stop others that may not want a contract from using the same tactics, even if that was not the sole purpose of the Addington?
 
I guess we are looking at a different definition of done. To me done means section 22 is finished and we have a contract where it can be used.

I really don't get the anger when I say that. I'm not saying your won't see the Nic in section 22, I can't say that because I don't know, it's just going to take a while longer and we all should have know this path would do that.

Sorry. I misunderstood. Done, to me, is the completion of the legal process and one side or the other accepting its fate and moving on. As far as ucrapa getting a contract I don't believe that will happen. The next contract will be settled in the next merger.

That is correct. I'm waiting on another call to verify this.

Okay, thanks for the clarification. Honest question: Do you see a possibility of USAPA not appealing all the way to the SCOTUS? Because that's where I see it ending and if there are other thoughts on this I'd like to hear them and not just have shots taken at me for asking. I realize that often questions on here are not really questions.
 
I think its far from over and I don't see how a ruling on a judger for a hearing is a win for the WEST...

It's also curious how west posters who claim to have been in court come out with some special wink that it's the east who is somehow spanked before we even start the trial?

The company openly stated that it believes it is obligated to use the Nic. Final and binding arbitration and a TA obligates them to do so. Why would the judge overturn this? She gets it. That's obvious. She will rule on #'s 1 and 2 leaving 3 moot. If she can't then you will have your chance. I believe she will and this mess will be over with.

The company will finally tell the east that the Nic is it and we will move on. Any retribution you may have planned will be squashed by the injunction against you. Parker no longer needs to placate you.

Common sense, no special wink.
I am not worried about the lava hitting my feet, but you should be.
