US Pilots Labor Discussion

I think you are mischaracterizing the situation, as you usually do.

While there is increasing disenchantment with Cleary and USAPA on the east, there is little change in stance on the NIC. Absent enough money from Parker to make the Nic list financially fair, the east would still vote "NO" on a contract that contains Nic.

The meltdown at USAPA has nothing at all to do with the Nic mess. It is 100% personality and politically driven.
The meltdown has everything to do with the Nicolau. usapa was formed to avoid the Nic. Everything was secondary to that goal and now even the strongest supporters see the court enforcing the arbitration.

Cleary has set himself up as usapa and the sole protector of DOH. that dream is failing and so is usasp. What else has Cleary promised? Read his last rant from the bunker. His 2 goals are a contract and seniority. Nicolau is coming and a contract is not. LOA 93 was a total bust and last chance for usapa to deliver anything without the Nicolau firmly in place.

Are you saying the conditions of the transition agreement do not have to be met?

Update for December 20, 2011: Safety Committee Chairman Tom Kubik's Resignation Letter

Dear Subscriber,

Back of The Trip Sheet Update: December 20, 2011: Safety Committee Chairman Tom Kubik emailed his resignation letter to USAPA's Officers and BPR. Should an important letter like Kubik's and the Safety Committee Chairman's concerns have been made available to the pilots?

Once again confirms what I've been saying:

I can confirm that Parrella knew LOA 93 was a loser. While I was still a rep, she did say that much at a BPR meeting. That was way before Kasher started deliberation on the case. I'll always remember Dave Westberg, DCA Vice Chair at the time, saying "What do you mean we are going to lose that grievance? we've been telling our pilots that we were going to win."
To that, Parrella shrugged her shoulder.
The BPR new about it and yet continued to raise false hopes. Despicable

So the Safety Committee Chairman asserts that the Safety Survey was hijacked for political gain and to try and gain negotiating leverage. As I recall there were quite a few east posters a while back stating that the survey results were reliable and revealed a genuine issue rather than the phantom issue which resulted in the injunction. I guess the truth is much closer to what I always claimed - it was nothing but a tool fashioned into a nefarious weapon with the purpose of trying to get Management to yield ground to USAPA that they could not gain through honest two-way negotiations. Management was right to avoid any and all participation in that process. Boy 2011 sure has turned out bad for USAPA and Cleary. Even I didn't know just how bad it would be and I was predicting a very tenuous year last December. From the looks of things 2012 is still all down hill for the unscrupulous scam of a "union" called USAPA.

Once again the east eats one of its own.

I stated a while back that Kubic resigned to keep his job. His involvement with the work action was obvious and the company singled him out. A condition was that he remove himself from all union involvement.

Kubic and Wells put the noose around their necks and USAPA helped the company kick the stool out from underneath them.

Can't wait to see you east guys flame Kubic.

Without further ado -

Officers and BPR;

This letter is a further explanation of my recent resignation as your safety chairman. First, I do have family medical issues that take a back seat to nothing. Family is always above all else. However, there are additional reasons for my resignation that you all need to know. It would not have been productive to air these in my emailed resignation letter as further divisiveness is foolish and does nothing for our pilots or our profession. This letter is personal, to each of you because each of you is responsible.

I can no longer work for a group of dysfunctional pilot "leaders".

You are all operating without the best interests of our pilots and profession at heart. You all fail to see the big picture of our profession. I can no longer accept that and continue to toil without all of you pulling in the same direction. What some of you have done with the safety culture survey is a disgrace. I urged the leadership of this union to find someone with expertise to advise us on what to do with the data from that survey. It did not happen. And we got #### slapped because of that lack of expertise.

The legitimate guidance issued by my committee was somehow turned into a slowdown and job action. It is my opinion that this was organized and sanctioned by folks within this union. Yellow lanyards and the associated phone calls etc.... were never approved or even discussed by our committee. The guidance we produced had zero impact on the on-time performance of this airline. The safety culture survey was hijacked. It was disgraceful. You gave the company an opening to further weaken this pilot group. And they did.

When my committee's guidance in regard to the survey evoked a threat of termination for me you did nothing to protect a threatened committee chairman thus rendering our committee and me helpless to continue to bring the culture problems to light. This pathetic non-response further emboldened this management who understands it can intimidate and usurp pilot authority with impunity.

While I could fill pages about all the ills you have brought upon this pilot group, from the office space nonsense, to physically assaulting each other, to the members having a goal of causing the failure of the union because of seniority, to fighting about lawyers and lawsuits and fraudulent emails, it would be senseless. I feel there is no leadership in this union and you are all guilty. Each one of you. Individually and collectively. It is a shame. Truly, it is shameful.

My purpose in accepting the safety chairman's job was to fight for our pilot group and our profession because economics was trumping safety. For that commitment I've received a threat of termination (with no response from the BPR/Officers), being accused of getting into the political gutter with you all, and most recently, having the committee's budget cut because of fruitless and senseless lawsuits that are not winnable. You all have cost me two outstanding co-chairmen as well. Sabel and McCarroll.

While I certainly might have been able to balance my family medical issues with this job I no longer have the desire to do so. It is a fruitless endeavor.

While you all certainly deserve each other, our pilot group deserves much better. East and West.

Tom Kubik

I wonder why Kubic waited until the injunction was issued before he suddenly decided that USAPA was dysfunctional? Didn't he go and make a fool of himself before the labor committee of the BOD about these safety concerns knowing that the safety survey was flawed? Was he on board with the call for Paul Morell to be terminated because of false claims from a manipulated safety survey that was only intended to scare Management into giving USAPA a DOH contract? These USAPA resignations are way too little and way too late for these Cleary followers to salvage any remnants of their personal integrity that was yielded to the east back of the van mentality.

An didn't you see that gun that was held to his head when he made those "safety" videos?

Just like Kubic, Valerie tried to play that game with the 330 and was busted by the company. You hear nothing from her or about her because she was a gnat's hair away from termination. That CVR convinced her to STFU.

It's Your Union...Time to Take it Back!; December 20, 2011

Yes Boys and Girls, it’ sad but true... the Grinch has stolen Pilot Christmas from you!

He is not bringing you a pay raise and a win on LOA 93, we have lost.

He has you under an injunction for a job action by your union that we cannot win and cannot afford the millions more required to defend. It will soon be made a permanent injunction by Judge Conrad in North Carolina.

He may be laughing all the way down the chimney if we get thrown out of court in New York, the law suit that Mike Cleary was told not to file by our former counsel.

He is also likely to put coal in the stockings of the Negotiating Advisory Committee. It appears that our negotiations may soon be “parked” by the NMB. This means no real progress is being made and the NMB has decided to let the parties sit idly by.

He has you back in court again which is now where it appears that your seniority will be decided. Not to worry, with appeals, it should only take another three or four years!

He can’t get along with anyone in Whoville, and still has four hundred grievances outstanding.

How’s it going so far?

Are you mad? So what! Who cares! The Grinch doesn't care and don’t expect Doug Parker to put a bonus in your stocking. Your union, under the direction of Mike Cleary, has been throwing rocks for the past three years, and all at your expense. If you want a contract you have to negotiate for it. To negotiate does not mean to alienate everyone you come into contact with and then file lawsuits against most of them. Negotiating for a contract does not mean alienating and disparaging other work groups and professional associations that we need to be working with every day. Negotiating does not mean forcing dedicated committee chairman, officers and BPR members to resign simply because they cannot endure the misguided Machiavellian attempts to rule our union by our current president.

We are desperate need of new leadership that understands the concept of mutual respect. It’s all in the art of the deal. There is no art in throwing rocks; it’s so easy even a cave man can do it. The choice is yours. You can continue to allow your current president to throw rocks or you can join us in supporting Gary Hummel for USAPA president and look forward to a happier holiday next year.

Sincerely,

Committee for a better USAPA

It looks like the Compass Correction guys are rallying around Gary Hummel to be their candidate to oust Mike Cleary. Here's a key comment, "You are receiving this email because your email address appeared in a data base that was used by USAPA volunteers prior to NMB certification."

It looks like the Compass Correction guys want to return to April 18, 2008.
