Explain that process to me, how NIC will be "forced" upon US Airways by Judge Silver. Cliff Notes version is ok tonight, I am taking up way too much of your time.

Everyone except Claxon understands that no court will force a SL on a union. But they can make it your only option.

That's what the DJ is going to do. The company won't move off the Nic because the courts won't grant relief from a potential DFR suit.

No Nic, no contract, and LOA93 all day, every day.
 
Let me be clear about my opinions. I believe DOH is the correct form of an integration and I believe the Nicolau Award is unfair to the East pilots. The most glaring inequity is Jim Zeigler. At the time of the merger Jim had 17 years and 3 months of continuous service at US Airways and he has never been furloughed. Jim was the most senior pilot on the Salamatt Report who was projected to upgrade - Joe Monda and Ralph Conrad were projected to retire). When the Nicolau Award was released Jim was junior to an AWA pilot who had 3 months of service, was an ALPA apprentice member, and was on probation with the Company.

Who had more influence on the combined business entity and produced more revenue for the merger to proceed? Jim or Dave O'Dell?

I believe most of us realize final and binding is final and binding and USAPA's approach is breaking the union and the membership's promise to integrate pilot groups per the pilot's contract. Do I like this? No, absolutely not. But, because I or some of us don't like this does not give USAPA the right to not abide by every section and every LOA of the pilot's contract.

I don't want to debate this too much longer. I believe within a short period of time Judge Silver will order US Airways and USAPA to implement the Nicolau Award. Shortly thereafter, I believe the new hires, East anti-USAPA pilots, and USAPA's PHX-based pilots will take control of the union and negotiate a new contract that includes the Nicolau Award because they prefer pay and benefit increases for everu US Airways pilots versus violating the likely DJ lawsuit SLI court order or remaining status quo.

Cannot figure out who that quip is a dig against. I think you actually offended both of us at once!

Most guys I know are "cordial and professional" no matter if "right" or "eating crow." I do both on a regular basis.

Take some notes, and maybe you will finally find the way to that left seat you so deserve and avoid, all excuses left behind.

A pilot that is gonna be a widebody captain for the last 12 years of their career anyway (yet who never had that career expectation)
And the eastie had what expectation? Being on the street shortly, out of a job...

When Phoenix has to resort to the one-sided "expectations" argument, the east has truly lost the argument.

How about letting me know if you're gonna be on the highways or byways around Guilford County. Since you never voted for traffic laws I suspect you feel no need to abide by them either so I want to stay safely home when you're in town. Come to think of it, you never voted for the laws against murder, rape, or theft....I better get a gun too. Gotta defend the family ya know - nothing personal... :lol:

East Captains are way underpaid and you're going doing everything you can to keep it that way.

Pretty lame for even you Matlock. Were laws concerning traffic, murder, rape, and theft covered under the Railroad Labor Act you might have point.

But I respect your "gun" comment, and will stay the heck off any roads in Guilford County. Is that were Clint Eastwood slept with that bored housewife for a while, or is it where Buford Pusser carried the big stick? Or maybe just were Aunt Bee got tipsy on the "elixir" she bought from a travelling salesman.

Funny, you didn't mention anything about the NMB when you made the claims of not making promises or voting on use of the Nic. It seems that your justification only applies to things that you don't like - the "I'll follow the rules if I want to but ignore them when I don't" quibbling of someone who cares little about anyone but himself...
