Since " ethics " has been argued since beginning of time, I can only offer my opinion to your LEADING questions.
If determined that the law " today " agrees with innocence of said west victims then one would have the " more righteous stance" to argue concerning your first 4 questions.
Do you typically reply to questions with questions?????

You see, Pops......everyone get's that you all (that's y'all for us Southerners) are upset with the Nicolau (unless you are in the top 517 ;-). What we don't get is that you feel you are on moral high ground to evade that final product of an agreed upon process.

Four years ago I though: Hey, I get it. Let's do this....Take 2/3 to 3/4 of our (west) dues money and place it in an escrow account. If USAPA's East pilots want to legally fight the Nicolau...great. Go ahead and assess yourselves to the extent that you wish to do a legal battle.

We did. We formed a LLC that is specifically designed to defend against the attack on our seniority. Works just like that. We would be where we are at now. You paying for yours. We paying for ours. That sounds pretty fair, don't you think?

What's more, is AFTER the Nicolau Seniority list is upheld by the courts (even Mike and Randy agree with me on that!) USAPA would have a few million in the bank! Wouldn't that be great? We could even throw a chunk of it in our Merger Fund (Guess how much we have in there now?......ZIP).

Regarding the "Cactus 18", many of those accused did NOTHING other than post on web sites that they would fight USAPA "democratic and transparent" union. It only cost those guys $5000.00 PERSONALLY in legal defense. Pretty nice, huh? Here's your opportunity to get educated (vs. believing the CRAP that comes from USAPA): http://cactus18.typepad.com/

So, you had about 200 East pilots below you at the PID as the ratio was 2:1. What's your problem? You were at the bottom before the merger and you are still relatively in the same place.

Internal union dispute...

I guess technically any DFR claim is an internal union dispute since it's between the union and it's member(s). But as much as the East would like to keep settlement of that particular dispute internal, there is plenty of precedent that says it's a dispute for the courts to decide.

As for the arbitration, if both sides agree to go to an outside arbitrator and abide by the decision of that arbitrator, is it still an internal union dispute or does the union, by not performing it's fair representation duties after the arbitrator rules make it a DFR issue and thus no longer an internal union dispute?

The problem USAPA has is the inconvenient little fact that the SLI was concluded per the policy and with the agreement of both sides to abide by that policy prior to USAPA becoming the CBA. So USAPA is not only inviting a DFR but violating a contract between three parties - one of which USAPA forced out of existence. USAPA should have either gotten it's votes rounded up sooner so it could be the CBA before the SLI was complete or taken up the East MEC's lawsuit over the propriety of the Nic. As usual, thinking all it needed was enough votes and it could do whatever it wanted, it's a day late and a dollar short. Having the votes means absolutely nothing in the DFR context.

John should be thankful. I wonder if any other manager that gave employee S.S#s to an LLC would only get a month off. I doubt it, they probably would have been fired.
What was it you said would happen? That all 3 of them were going to jail. That usapa has a case and law enforcement was after them.

When was Nicolau hired as an airline pilot and became an ALPA member? ALPA didn't accidentally hire an outside arbitrator.

He is what makes the internal, external. The agreement between the parties made it binding.


We can have conversations about two issues at once if you like. The first issue about whether a union DFR can be judged outside of the court is abundantly obvious. A vote does a marvelous thing when people disagree about what is fair.

This second issue of "internal" versus "external" is quite interesting. Unlike fairness, union members have to rely on courts to determine if a dispute is internal or not. The 9th of course was pretty clear.

The nic has been one vista on the journey to a joint contract.

BTW, my "rationalization" is basically legal fact (as demonstrated by the district courts). Courts will finish this. The pity is that integrity, honor, common sense and decorum should have lead the way. IMHO.

Dismissive a result of my perceived inability to converse as an adult with you.
I gave an inch in my original reply, only to get ongoing " feelings " in response.
Bottom line.......if the courts have not stamped an issue final, then it's NOT.
You frame your questions as FACT, they are not. At least not yet!
