I'm still trying to understand if there is any significance to the MDA issue and why it keeps coming up. Unless I'm missing something, the only pending court action related to pilot seniority integration is the Declaratory Judgment matter before judge Silver. Is that correct? If so, then searching through the court filings related to the three party's request for summary judgement, the three statements of fact filings, and the various declarations I find exactly zero (0) references to an MDA issue or any legal questions regarding the validity of the Nicolau Award as it relates to the RLA, the provisions of the TA, or anything else that might legally prevent USAPA from moving forward with the unmodified list in S22 negotiations. So, if this is such a big issue as to fill about 10 pages of posts in the last day, why didn't USAPA mention an MDA issue in their filings before judge Silver? Seems to be just another diversion topic so the east can strive to have another excuse not to accept the results of binding arbitration and for USAPA not to honor their DFR responsibilities.
