Nobody is going to change their position based on what the other guy wants.

I've posted about this in another thread, but I believe the outcome of the DJA is a foregone conclusion.  From my prior work experience outside the airline industry, I am very familiar with legal documents and arguments.  I have learned from experience how to recognize when an attorney is pressing an argument they know is a loser in service to their client.  (Take a look at some death row appeals sometime - lengthy, well-written, but usually full of more holes than my kitchen colander!)  USAPA's arguments in the documents before Judge Silver carry this same air of defeat.  I feel quite certain that, privately, USAPA's legal team has informed the BPR that their odds of prevailing before Judge Silver are infinitesimally small.  I do not expect that the BPR would share that information with the rest of the pilot group, preferring instead to cast blame elsewhere if/when they are defeated in court in Phoenix.

I strongly suspect that, when Judge Silver hands down her decision, not only will the unaltered Nicolau award be ordered by the court to be part of any CBA agreed upon by USAPA and US Airways, but the ruling and its legal supporting arguments will be strong enough that the USAPA legal team will recommend strongly to their clients AGAINST an appeal to the Ninth.  Then, however the runoff turns out, we will see who among the USAPA officer corps and BPR wishes to face reality and move forward, and who wishes to continue on their cash-burning Quixotic quest while my family (and the families of 5000 of my fellow US Airways pilots) suffer along the way earning far less money - and enjoying far lesser work rules and benefits - than we should.

I agree that this is the most likely outcome from the courts. The extremists on the east though will convince the majority that, "we'll win on appeal." All this will be is a way for the extremists to delay the Nic and a contract. That's the way I see it anyway.

The guy that said that is a 3rd Lister E190 F/O new hire. He hasn't even been on the line for 7 months. He doesn't even know which way is up yet, and still has a probationary checkride to pass. I wouldn't take what he says as the gospel by any means. And notice I did not out this individual, but he should be a little more careful of what he says.....while i don't hold what he says against him, there are others that might. Not too smart to be sticking your head up in no mans land when you're on probation.

#5. I don't regret the money I have lost other than the pension that alpa gave away (and I have recouped that on my own). I also have no regrets about my choices other than the fact that I once believed in alpa and what some of my alpa reps preached.
ALPA is an organization made up of people. Just like usapa is run by people.

What is the name of the person at ALPA that gave away your pension? The organization did not do it a person did. Name please.

Are you saying that there are chief pilots or check airman or management types that would use what someones says concerning union politics and threaten their job? Or would it be fellow pilots that don't agree with someones position?

You east guys kill me that you consider someone to be a lesser pilot on probation. Good thing you guys stayed in business and did not have to become probbies again. That would be quite a blow to some of the 55 year old egos on the east.

Only a low life threatens the job of a man who dares to disagree.
