Agenda Item - Mike Cleary claim on USAPA Trademark/Vacation update
The Board spent approximately 30 minutes on this item and determined the claim on the trademark was meritless because it must be used in commerce and the claim for vacation pay was not in accordance with LOA 95. On advice of counsel, the following motion was moved/seconded by Stein/Frear and passed 10-1 (No - CLT Borman).


No-CLT Boreman. Flounder all by himself....

Meanwhile, LuvClaxon are consoling each other.

Hummel will be out soon.  The 9th circuit will take care of the rest in a few years, after a lower court makes the same mistake twice.

Hey everyone, do you have trouble finding Christmas gift items?   america west employees working for the great profit machine, have ideas for you. 
 
How did they get those items from the company?  The next thing you know they will have a management pilot steal employee personal information from company computers and hand it over to a third party.   er...,,.. nevermind.

Hey I called that 1 800 number and it did not connect.  I wanted to order pre ATSB loan awa items.  If those items were taken from your company without consent,  I will not order.

Ah! "Cap'n Aux" 😉 A more clinically perfect "poster child" for Arrested Development could generally, only be found amongst some Hollyweird people, and the sad progeny of indulgently wealthy (and without ANY semblance of proper parenting) examples = Paris Hilton/etc. That doesn't make the youngster anything inherently "evil", by any means....Just completely clueless. One should assume in such cases, the wholesale lack of any external/real world, or personally severe, self-testing throughout life produced results of that order. IE: It's very easy to be a "spartan"/"knight"/'dire wolf"/etc, ONLY if if one never exits Fantasyland.....Or  perhaps even Peter Pan, again, only if safely nestled within Wonderland's confines. Outside of that?...The unknown element of possibly losing a father at a young age could well play in, in some cases. Enough two-bit "Dr. Phil" BS without adequate data. A lot of circumstantial combinations sometimes cause a child to "freeze" at some "safe" point in personal development, and I can't presume to really speak for whatever happened to that poor fellow, purely based on Facebook nonsense/infantile videos/'spartan"/"knights"/etc fantasies.

What would you care to bet Silver isn't going to dismiss this on the 9th based upon your logic?
 
I'm leaning towards voting No for the recall. It seems like a moot point to do it. Once the APA become our CBA, he will be gone anyway. I would think the current BPR members will stay in their current roles under the APA as reps for our domiciles (Not sure what happens in DCA though).
 
The MOU is signed and will be set in motion on Monday. And according to the Merger Committee, the East list and the West list will be used for integration with the APA. So a three way like I thought all along... I would think this is what the pilots want. With Gary staying President, things should progress along these lines.
 
A recall opens a lot of uncertainties at a critical time. Who will become President, and more importantly, what does the new President and his/her supporters think can be accomplished other than what is already happening? A re-do of the MOU? Not gonna happen.
 
Surely a new President would have the ability to completely change our Merger Committee and their current objectives. Why would we want that?
 
The West reps are VERY supportive about getting Gary out (And Steve). Why is that? What does the West see as a benefit for a successful recall?
