It is no surprise, then, that the conduct USAPA alleges
closely resembles conduct we have found not to demonstrate
continuity after H.J. Inc. See, e.g., GE Inv. Partners, 247 F.3d
at 549 (finding no continuity where the defendants’ "single
goal" was to fraudulently inflate the value of and then sell
their controlling interest in a company); Menasco, 886 F.2d at
684 (finding no continuity where "[d]efendants’ actions were
narrowly directed towards a single . . . goal," "involved but
one set of victims," and took place over a relatively short
period of time).
 
Because the appropriate "commonsensical, fact-specific"
examination of the allegations in USAPA’s complaint fails to
yield a pattern of racketeering activity, USAPA has failed to
state a cognizable RICO claim. See Menasco, 886 F.2d at 684.
Accordingly, the district court did not err in granting the
defendants’ motion to dismiss the complaint.
IV.
We can quickly dispose of USAPA’s remaining
contentions—that the district court erred in denying it leave
to amend its complaint and in refusing to grant it injunctive
relief.
 
 
The judgment of the district court is
AFFIRMED

No possible defense of even the "knights" I see. How about this kind of immature, "heroic" BS?  "Free men cannot start a war....So it it always the herd men who win battles and the free men who win wars". Seriously? Just what supposed "war" are "you'se" Fantasyland "soldiers" fighting in?

The Justice Department is near an agreement to settle its fight with American Airways and US Airways over their proposed merger, a person briefed on the matter said on Tuesday.
Shares in US Airways were halted for pending news on Tuesday morning. They had risen 3.5 percent after Bloomberg News reported that a settlement had been reached.
A pact is expected to be announced soon, forestalling a trial on the Justice Department’s lawsuit scheduled for later this month.

It isn’t clear what the terms of the settlement will entail. But Eric H. Holder Jr., the attorney general, has indicated that any agreement will revolve around concessions on airport takeoff and landing slots, particularly at Reagan National Airport near Washington. The two airlines control about two-thirds of the slots at that airport.

A merger of the two airlines, announced earlier this year, would create a new behemoth and would help lift American’s parent company out of a two-year-old bankruptcy case.

I must respectfully differ, in that, as actual warriors, the real-life Spartans knew no equal in their time, and I'd have to argue that the bloody nose King Leonidas and a few thousand allied Greeks gave the Persian mega-horde at Thermopylae likely served to seriously demoralize that enemy, and also allowed Athens and the city states time to pull their thumbs outta' their collective keisters and get serious. It's arguable that the earliest (and only) notions of democracy might well have entirely perished otherwise, perhaps to never be seen again anywhere. I'd say western civilization owes them much for their sacrifice at that first battle. It must be noted though, that a buncha' narcicisstic punks that can magically even begin to imagine themselves to be "spartans"...well...simply have to be laughed at. The only common AWA theme to be seen here is both their easy willingness to try and contemptuously usurp and assign to themselves the worked years of others....much less even considering the earned glory of Spartans, so long ago.
 
On my most "tough-guy" day ever; I couldn't begin to imagine being an actual Spartan, as these westies seem to have no trouble fantasizing themselves. If anyone needs a really good laugh; take a brief look at Spartan upbringing alone, and then try to even imagine what they'd have thought/felt about any pathetic little pimples proclaiming: "This is Sparta!"...."I'll let the courts do my talking for me!"  Sigh!....I suppose if one's childish narcicissm knows no bounds...Well..It would explain much hereabouts. 😉

The group of former America West pilots is known as Leonidas, after the Spartan general who stood against an army of Persians.
